USPTO withdraws Notice of Proposed Rulemaking on PTAB Rules of Practice for discretion to institute an AIA review
The USPTO has announced in a Federal Register notice the withdrawal of the April 19, 2024, notice of proposed rulemaking (NPRM) that would have revised the rules of practice for inter partes review (IPR) and post-grant review (PGR) proceedings that the Patent Trial and Appeal Board (PTAB) used in exercising discretion to institute IPRs and PGRs.
The USPTO has withdrawn the NPRM to evaluate future actions in light of the administration’s current priorities. Despite the decision to not move forward with the NPRM at this time, the USPTO appreciates the thoughtful perspectives that commenters raised previously and welcomes continued stakeholder feedback as the Office considers and determines a course of action.
