August 5: Public roundtable on AI and protections for use of an individual’s name, image, voice, likeness, or reputation
Program will help develop public policy recommendations at the intersection of AI and IP
Artificial intelligence (AI) technology enables new and efficient ways to create digital media. AI-generated images, audio, and video can incorporate an individual’s voice, along with their name, image, and likeness (NIL), impacting their reputation and rights. The unauthorized use of AI-generated NIL content can implicate federal trademark and copyright laws, as well as state NIL laws.
To hear from the public on the legal and policy issues at the intersection of AI technology and NIL protections, the USPTO will hold a roundtable on Monday, August 5, 2024.
The roundtable will consist of two sessions: An in-person session at USPTO headquarters in Alexandria, Virginia, and a separate, virtual session. Both sessions will be livestreamed. There is no charge to participate, but advance registration is required.
Input received during this roundtable will assist the USPTO’s work to develop intellectual property (IP) policy recommendations for the administration regarding the intersection of AI and IP, in accordance with the Executive Order on AI issued by President Biden in October 2023. In developing these IP policy recommendations, the USPTO will also take into consideration input received during its other listening sessions on these topics, as well as relevant reports issued by the U.S. Copyright Office and relevant comments submitted to the U.S. Copyright Office in response to its Notice of Inquiry on these issues.
“We are committed to encouraging the safe and responsible use of AI and look forward to hearing the public’s views on the important topic of AI and protections for use of an individual’s name, image, voice, and likeness,” said Under Secretary of Commerce and Director of the USPTO Kathi Vidal. “Your feedback will help us directly shape future policy as we work to achieve the right balance between fostering AI technology and protecting individuals’ reputational rights.”
For details about the roundtable, including sample questions that participants may wish to address, read the Federal Register Notice published July 1, 2024.
