Trademark Manual of Examining Procedure has been updated

The November 2023 version of the Trademark Manual of Examining Procedure (TMEP) is now available on the USPTO website. The TMEP is the primary resource for information about the trademark examination process. This update furthers our goal of promoting transparency regarding our policies and procedures and ensures that our examining attorneys and customers have access to the most current information on those policies and procedures. 

This revision includes citations to precedential legal opinions from the Trademark Trial and Appeal Board and the Federal Circuit issued prior to October 31, 2022, changes due to The Trademark Modernization Act of 2020, the 12th edition of the Nice Classification of goods and services, and examination guidance issued since the July 2022 version. Read the outline highlighting some of the clarifications and changes in the November 2023 version.
