Changes in Patent Cooperation Treaty (PCT) fees

The United States Patent and Trademark Office (USPTO) fee schedule was updated with the following changes, effective April 1:

Decrease in PCT fees – international stage

  • 2602/3602: Search fee - regardless of whether there is a corresponding application (see 35 U.S.C. 361(d) and PCT Rule 16) – small entity fee decrease from $1,090 to $872; micro entity decrease from $545 to $436
  • 2604/3604: Supplemental search fee when required, per additional invention – small entity fee decrease from $1,090 to $872; micro entity decrease from $545 to $436
  • 2605/3605: Preliminary examination fee - U.S. was the International Searching Authority (ISA) – small entity fee decrease from $320 to $256; micro entity fee decrease from $160 to $128
  • 2606/3606: Preliminary examination fee - U.S. was not the ISA – small entity fee decrease from $400 to $320; micro entity fee decrease from $200 to $160
  • 2607/3607: Supplemental examination fee per additional invention – small entity fee decrease from $320 to $256; micro entity decrease from $160 to $128
  • 2627/3627: Late furnishing fee for providing a sequence listing in response to an invitation under PCT rule 13ter – small entity fee decrease from $160 to $128; micro entity fee decrease from $80 to $64

Increase in PCT fees to foreign offices

  • 1712: International search, IP Australia (IPAU) as ISA – fee increase from $1,419 to $1,523
