USPTO seeks public input on initiatives to improve the robustness and reliability of patent rights

The United States Patent and Trademark Office (USPTO) has released a request for comments on initiatives directed at bolstering the robustness and reliability of patents to incentivize and protect new and nonobvious innovation while also facilitating the broader dissemination of public knowledge to promote innovation and competition. The request for comments is available in the reading room of the Federal Register notice.

The request for comments seeks input on a variety of topics, including prior art searching; support for claimed subject matter; request for continued examination practice; restriction, divisional, and rejoinder practice; non-statutory double patenting practice; and certain initiatives related to these topics that the USPTO recently outlined to address the Biden Administration’s goal of increasing competition in the pharmaceutical marketplace.
