ESTTA Changes: Plan Ahead

On Saturday, January 14, 2017, from 12:01 a.m. until 2 a.m., Eastern Time, ESTTA (Electronic System for Trademark Trials and Appeals) will be unavailable due to system maintenance. The enhancements to be released include: 

  • Modification of the Extension of Time to Oppose forms to require and accept fees for certain extension requests
  • Removal of the requirement that filers specify the method of service on a “Certificate of Service” screen, but only for Notices of Opposition and Petitions to Cancel
  • Update of the “Certificate of Service” (required for all other filings) screen to include “email” as a separate selection

Due to the ESTTA enhancements, implementation of amended rules of practice, and increased and new fees, all effective on January 14, 2017, any “Save Session” created before January 14, 2017 will be locked and unavailable for completion by the prospective filer after midnight on January 13, 2017, for the following forms: Extension of Time to Oppose; Consent Motions; and Change of Correspondence Address. A filer who used the “Save Session” feature before January 14 to save any of these forms will receive a “Warning” when returning to ESTTA on or after January 14 and selecting the saved session. The filer will be required to start the process again with updated forms.
