Ozburn-Hessey Logistics has taken action to reinstate nine wrongfully discharged employees and cease anti-union activities in compliance with a January 29th order from the United States District Court for the Western District of Tennessee. District Judge John Fowlkes found that there was cause to believe Ozburn-Hessey had engaged in a series of unfair labor practices and granted the National Labor Relations Board’s request for relief in order to prevent irreparable harm to the terminated employees and continued misconduct by the Employer.
Ozburn-Hessey is transportation, warehousing, and logistics services company located in Memphis, Tennessee. The NLRB’s Region 15 Office in New Orleans issued a complaint alleging that Ozburn-Hessey had violated that National Labor Relations Act by discriminatorily discharging nine employees, taking disciplinary action against several union supporters, engaging in threats and surveillance, and performing drug and alcohol testing on employees because of their union activity.
In addition to offering reinstatement to the nine discharged employees, Ozburn-Hessey has agreed to take interim measures to assure employees that surveillance, threats, and other retaliatory actions in response to union activities have ended.
