The Tax Cuts and Jobs Act of 2017 included major changes to section 174 of the Internal Revenue Code to take effect in 2022. These changes require businesses to amortize R&D expenses over a five-year period instead of deducting them in the year they were incurred. The NIH recognizes this change may negatively impact some small businesses. Small businesses that receive SBIR or STTR funding should seek guidance from the IRS or a trusted tax advisor on how this change may affect them.
Note: Federal income/excess profits taxes are strictly not allowable charges to NIH awards, either as direct or indirect costs. (see FAR 48 CFR 31.205-41). SBIR and STTR application budgets may include a “fee” that may be used by the small business for any purpose, including payment for a tax liability. The e-C3i course is designed to provide medical device innovators with an educational foundation of business frameworks and tools to assess the opportunity to translate an idea from the lab (concept) to the market (clinic). Participants in the e-C3i Program will learn an initial set of core skills that will enable them to:
- characterize the unmet market need
- identify the key product attributes
- conduct customer and stakeholder interviews
- validate the business opportunity
The e-C3i course is being offered to investigators with active NIH (non-SBIR/STTR) research grants from participating Institutes and Centers. Additionally, project teams that successfully complete the e-C3i course will be eligible to matriculate into the core C3i Program for continued entrepreneurial training.

The NIH Applicant Assistance Program (AAP) is designed to assist small businesses that have never received NIH SBIR/STTR funding in preparing and submitting a Small Business Innovation Research or Small Business Technology Transfer (SBIR/STTR) application.
The goal of this program is to increase participation in the SBIR program by socially/economically disadvantaged small businesses, women-owned small businesses, and small businesses located in under-represented states.
The AAP application portal will open on Tuesday, April 25, 2023, and information about the AAP is available at the NIH AAP website. For more information about the AAP, be sure to attend the AAP Informational Webinar and AAP Q&A Office Hour.
All applications must be submitted no later than Monday, May 22, 2023, at 5:00 PM ET.
Recent Phase I NIH SBIR or STTR awardees (grant, contract, or Fast-Track) may request a free Technical and Business Assistance (TABA) Needs Assessment Report provided by RTI Innovation Advisors that provides an assessment of your project’s progress in four technical and business areas:
- Market Needs/Competitive Advantage
- Intellectual Property/Barriers to Entry
- Business Model Profitability
- Manufacturing, Regulatory, and/or Clinical Plan
The Needs Assessment Report helps companies strategize for their project’s next steps. There is no cost for this report and the time commitment for participation is minimal.
