Pooled Employer Plan Amendments in Pre-Approved Plans The IRS issued opinion letters for third cycle pre-approved defined contribution (DC) plans on June 30, 2020. These opinion letters provided plan sponsors with reliance for the qualification changes in the 2017 Cumulative List. Plan providers have asked about amending their DC plans for Pooled Employer Plans (PEP), a new type of multiple employer plan provided by the SECURE Act. The IRS is creating language for plan providers to use to amend their current pre-approved plans to add a PEP feature. Providers may create their own PEP amendment, but they will not have reliance on those provisions. Please note that an amendment to add a PEP provision to a current pre-approved DC plan is not considered a modification for purposes of applying for a determination letter on a Form 5307, because it involves a law change after the 2017 CL.
