RI Supreme Court Opinion re Certified Question on Exemption of Inherited Individual Retirement Annuity under RI Law
On April 12, 2018, the US Bankruptcy Court for the District of Rhode Island certified the following question to the Rhode Island Supreme Court: "Whether a debtor may claim an exemption in an inherited Individual Retirement Annuity pursuant to RI Gen Laws §9-26-4(11)?" On December 11, 2019, the Rhode Island Supreme Court issued its opinion on the question in In re Lynette Kapsinow (No. 2018-94-M.P. (BK 16-11859)), and answered Yes.
