EPA Updates the General Permit Conditions Module
On January 24, 2025, EPA updated the general permit conditions module of the Resource Conservation and Recovery Act Model Permit. The update includes adding provisions from the hazardous waste electronic manifest third rule that is now effective.

EPA Adds Legacy Sites to Website
On January 28, 2025, EPA updated the list of Internet sites to add facilities with legacy coal ash surface impoundments. The list also provides links to facilities that have identified “potential” legacy CCR surface impoundments, consistent with the regulations that allow time for further investigation to determine whether the unit meets the regulatory definition of a legacy CCR surface impoundment.

EPA Confirms Adequate Hazardous Waste Capacity Through 2049
On February 7, 2025, EPA posted the “2024 National Capacity Assessment Report.” In this report, EPA determined that the U.S. has adequate capacity to treat and dispose of hazardous waste likely to be generated between now and 2049. The Agency’s determination relies upon the most recent Biennial Report data submitted by states on hazardous waste generation and management, permits, export data, and information from commercial management facilities.
Alongside the report, EPA also issued an updated statement for national capacity language that can be used in all new or amended Superfund State Contracts and Remedial Action Cooperative Agreements signed between the EPA and states, beginning immediately and through December 31, 2029. The 2024 assessment indicates that there exists the availability of adequate capacity nationwide for the destruction, treatment, or secure disposition of all hazardous wastes reasonably expected to be generated through December 31, 2049. Based on this conclusion, any state entering into a State Superfund Contract or remedial response Cooperative Agreement between January 1, 2025, and December 31, 2029, may provide assurance of adequate hazardous waste treatment or disposal capacity for the 20 years following the contract/agreement date, as specified under Comprehensive Environmental Response, Compensation, and Liability Act Section 104(c)(9).

EPA’s Office of Resource Conservation and Recovery Publishes Fiscal Year 2024 Accomplishments Report
On February 26, 2025, ORCR published its Fiscal Year 2024 Accomplishments Report in a new web-based format. This report celebrates how ORCR supported EPA's mission to protect human health and the environment through the office's work on safe, effective, and economically sound waste management. This work includes hazardous waste permitting and cleanup, recycling and composting guidance, coal ash regulations, research, programmatic support, and much more.
