We would like to invite you to our upcoming DBE/ACDBE Final Rule Changes: DBE Open Ended Performance Plans (OEPP) for Design-Build Contracts.

The session will explain and give examples of the DBE final rule change requiring DBE open ended performance plans (OEPP) on design-build contracts (49 CFR 26.53(e)). In design-build, the contract is awarded when the project is minimally designed, and many details are unknown. These details are essential to formulate DBE subcontracts. Instead of proposers submitting a list of named DBEs as required by 49 CFR 26.53(b), the OEPP verifies the proposer’s commitment to the DBE goal with a list of future anticipated subcontracting opportunities for DBEs, including anticipated dollar value and a timeframe.
