The Office of Federal Contract Compliance Programs (OFCCP) has posted a second updated list of non-objectors whose EEO-1 Type 2 data the agency intends to release in response to a Freedom of Information Act (FOIA) request.
In response to the FOIA request from the Center for Investigative Reporting (CIR) for Type 2 EEO-1 data for all federal contractors during the 2016-2020 EEO-1 reporting years, OFCCP provided federal contractors with multiple notices and opportunities to object to the release of this data. On February 2, 2023, we posted a list of all entities that, according to the agency’s records, were federal contractors that submitted Type 2 EEO-1 data between 2016-2020 and had not submitted objections to the release of this data. Shortly after publishing the initial list, the agency learned that the list included some contractors that had previously submitted objections. On February 16, 2023, OFCCP posted an updated list of non-objectors that removed contractors that objected prior to publication of the initial list, as well as entities that responded to us between February 2 and February 10, 2023, asserting either that they were not a federal contractor or otherwise objected to their inclusion on the list and the disclosure of their data.
Today, we have posted a second updated list (Second Updated List), reflecting removal of contractors and objections as described above through March 3, 2023. We have not yet made any determinations regarding the substance or merit of these entities’ responses or objections and has removed these entities from the initial disclosure to CIR pending our determinations.
This update will be the final posting of a list of non-objectors. Contractors should consult the Second Updated List and notify us as soon as possible, but no later than March 17, 2023, if they believe their entity has been improperly included. The Second Updated List is available at the following link: Non-Objectors Contractor List. If your entity is not listed, no action is necessary at this time.
If you believe your entity was improperly included on the Second Updated List, please send an email to OFCCP-FOIA-EEO1-Questions@dol.gov, including at a minimum the following information: (1) all addresses associated with your entity for the reporting years in which your entity is listed; (2) your entity’s EEO-1 unit number; (3) any other entities associated with your organization (including, e.g., merged companies and subsidiaries) that you intend to cover in your objection, with any additional entity information needed to confirm the objection (including EEO-1 unit number and address, if different from those identified in response to (1) and (2)).
We encourage all recipients of this message to consult the posted Second Updated List. All responses must be received no later than March 17, 2023, at 11:59 p.m. EST, via the email address below and must include your organization’s EEO-1 unit number(s).
As required by FOIA, after the close of all response periods, we will release the Type 2 data of contractors that have not objected to the release of their data. Because we have received three or more requests for the same information, FOIA requires that we post the data released to CIR on our website at
