On November 18, 2021, the Office of Personnel Management (OPM) issued the attached memo “Annual Leave Restoration Procedures for Leave Year 2021” to remind agencies of the annual leave authorities and expiration dates for 2021, related to normal annual leave restoration procures and special rules provided for CVOID-19 pandemic. Per their memo, the “Higher Annual Leave Carryover Limit under Section 1111 of the National Defense Authorization Act for Fiscal Year 2021”, must be used during leave year 2021. This means it must be taken no later than January 1, 2022, or it will be forfeited. It cannot be restored, included in a lump-sum annual leave payment, and may not be donated under a leave transfer program.
Government agencies have had certain circumstances that allow for more than normal exigency of the public business, and pandemic responses, for purposes of annual leave restoration for employees. All hours in excess of an employee’s annual leave ceiling will be forfeited at the end of the leave year, January 1, 2022. For forfeited annual leave to be considered for restoration under 5 U.S.C. 6304(d) (1), it must have been scheduled in writing no later than November 20, 2021.
Like last year, in place of individual approvals being sent to the Payroll Operations Division, and to ease the manual process, the Interior Business Center (IBC) is evaluating an automated process to restore leave for leave year 2021. We plan to issue guidance within the next couple of weeks.
