1. REFs (A) and (B) established that the mandate for service members
to take the COVID-19 vaccine was unlawful as implemented, unfair,
overbroad, and an unnecessary burden, and that service members were
unjustly discharged for refusing the vaccine. As a result, REF (C)
announced the Coast Guard's process to return any member voluntarily
or involuntarily separated as a result of the Coast Guard's COVID-19
vaccine mandate. Over 272 members have taken advantage of this
opportunity and the opportunity for returning to service
remains open.
2. The Coast Guard supports expressive activities to include
religious expression. Accommodation of sincerely held religious
beliefs is and has been a pillar of the Coast Guard's commitment
to treating all service members with dignity and respect. The
Coast Guard works to support each service member's religious
practices to the broadest extent possible within the bounds of
military readiness, unit cohesion, good order, discipline, health,
and safety. Discrimination on the basis of religion is contrary to
the Coast Guard's core values of honor, respect and devotion to
duty. REF (D) states that discrimination on the basis of religion
is illegal. Members are encouraged to consult REF (D) for more
information.
3. This message reiterates that no Coast Guard member will be
disadvantaged in promotions, advancements, assignments, or other
opportunities based on COVID-19 vaccination status or a break in
service resulting from the mandate. In accordance with REFs (E)
and (F), medical or physiological conditions, including vaccination
status, are prohibited comments in officer and enlisted evaluation
reports. Furthermore, REFs (E), (F) and (G) make clear that
promotion and selection boards are prohibited from discussing
medical information or any information beyond matters of record
presented to the board or panel. As per REF (H), all CG-3307
Administrative Remarks Entries have been removed from Coast Guard
Military Human Resources Records for all Coast Guard members who
decided to not receive the COVID-19 vaccination. Any record entries
or consideration by boards or panels of a member's vaccination
status, decision not to take the vaccine, or separation during
the COVID-19 mandate are prohibited. Members will not consider
another member's COVID-19 vaccination status, any allegation
that the member violated an order regarding the COVID-19
vaccination, or any break in service for promotions, advancements,
assignments, or other opportunities.
4. All CG-3307 (P&D-41 (series)) administrative remarks documenting
the decision to remain unvaccinated have been removed for those who
decided not to receive the vaccination. Any record entries or
consideration by boards or panels or a member's vaccination status,
decision not to take the vaccine, allegation of disobeying an order
to receive the vaccine, or separation during the mandate is
prohibited.
5. Upon request, any member who requested a religious accommodation
from the mandate can have their personnel record reviewed and any
remaining documents that state vaccination status or decision to
remain unvaccinated for COVID-19 removed. A member may also request
the removal of the February 2, 2023, memorandum signed by the
Acting Assistant Commandant for Human Resources (CG-1), ordering
the removal of the CG-3307 (P&D-41 (series)). This document was
placed in records to document the removal and was only viewable
by the individual member and records management personnel. Members
may request removal of CG-3307 (P&D-41) and Acting COMDT (CG-1)'s
memorandum by emailing their requests to
hqs-smb-cgpsc-mr-customerservice@uscg.mil.
6. In accordance with REF (I), the COVID-19 vaccine is not a medical
readiness requirement. As such, COVID-19 vaccination status shall
not be considered in assessing individual service member readiness,
suitability for assignment, or any other operational mission.
