1. REF (A) confirms the Coast Guard’s commitment to
eliminating sexual assault from our Service. This can
announces a change to the Coast Guard’s policy on sex offenders
residing in Coast Guard controlled housing and reinforces our
commitment to eliminating sexual assault in the Coast Guard.
2. Currently, paragraph 1.C.4.c.(8) of REF (B) requires Local
Housing Authorities (LHA) to “Comply with federal and state
laws to impose registered sex offender residency restrictions.”
Effective immediately, except where prohibited by law or
otherwise waived by appropriate authority, no person required to
register as a sex offender per REF (C), or per the state laws in
which the unit is located may occupy any Coast Guard controlled
housing.
3. This policy applies to all Coast Guard controlled housing to
include owned, leased or privatized family and unaccompanied
personnel housing wherever located. This updated policy, along
with waiver and appeal procedures will be incorporated into
paragraph 3.C of REF (B) within the next year.
4. The Sex Offender Policy Acknowledgement and Disclosure
Form (CG-5370A) has been created to make housing applicants
aware of this policy change and to disclose any registered sex
offenders including oneself, who would reside in Coast Guard
controlled housing. Effective immediately, in addition to the
Application for Assignment to Housing (DD-1746) all
applications for assignment to Coast Guard controlled housing
must also contain a signed CG-5370A. This requirement applies
to all applicants, including Coast Guard service members,
Department of Defense service members, civilian employees, or
and any other applicant for assignment to Coast Guard controlled
housing.
5. If any member or a resident in his/her Coast Guard controlled
housing is subsequently required to register as a sex offender,
the member must notify the local housing office in writing within
three business days of the registration requirement. Residents
who occupy housing but are then required to move due to a
subsequent sex offender registration may be entitled to a local
move pursuant to paragraph 051903.B.1.a.(2) of REF (D).
Applicants found to have falsely certified that no registered sex
offenders including themselves, would reside in Coast Guard
controlled housing will be considered for eviction and may be
responsible for relocation expenses.
6. Applicants that disclose a sex offender would reside in Coast
Guard controlled housing must not be assigned to Coast Guard
controlled housing. Applicants may request a waiver via memo
from the Area Housing Authority (AHA). Waiver requests must
be routed through the member’s Commanding Officer (CO) or
Officer in Charge (OINC) to the CO or OINC with cognizance
over the housing location (if different) to the AHA. Waiver
requests should include the recommended information on the
CG-5370A.
7. Individuals that are precluded from occupying Coast Guard
controlled housing pursuant to this policy will be directed to
find housing as if Coast Guard controlled housing is unavailable.
8. This message will be cancelled on 03 FEB 2022.
