CSMS # 69994928 - GUIDANCE: Import Ban of Certain Polysilicon Products Under Proclamation 11052

The purpose of this message is to provide guidance regarding the U.S. Department of Commerce’s (Commerce’s) Temporary Final Rule (TFR) on Measures to Restrict Stockpiling of Polysilicon and Polysilicon Derivatives Under Proclamation 11052.

BACKGROUND
On September 24, 2026, Commerce will publish a TFR providing for procedures for an import ban on certain imports of polysilicon products. See Federal Register :: Public Inspection: Measures to Restrict Stockpiling of Polysilicon and Polysilicon Derivatives under Proclamation 11052.

The TFR was issued pursuant to Presidential Proclamation 11052 “Adjusting Imports of Polysilicon and Its Derivatives Into the United States.” See 91 FR 51975, August 6, 2026.

GUIDANCE
Pursuant to the TFR, when Commerce informs U.S. Customs and Border Protection (CBP) that an importer of record (IOR) has been determined to be importing polysilicon products in volumes substantially greater than their historic averages or that a new IOR is exceeding the applicable weekly quantity limits for polysilicon products, the IOR thereafter is prohibited from making further entries of certain polysilicon products into the United States prior to December 4, 2026. CBP will not allow the IOR to make entries of such products into the United States until December 4, 2026.

The IORs subject to the restriction may move the goods to a bonded warehouse but may not enter the goods for consumption before December 4, 2026.

Pursuant to the TFR, IORs that are prohibited from entering polysilicon products into the United States may apply to Commerce to waive this prohibition.
