CSMS # 62093369 - In-bond Regulations – Reporting In-bond Arrival with Required FIRMS Code (All MOTs, excluding Air); ACE Report TA-003 (Public FIRMS)
Office of Field Operations, Cargo and Conveyance Security (CCS) Directorate is issuing this additional guidance to the trade and cargo logistics community regarding the reporting of Facilities Information and Resources Management System (FIRMS) codes when submitting the in-bond ‘arrival’ notification in the Automated Commercial Environment (ACE). U.S. Customs and Border Protection’s (CBP) in-bond regulations (19 CFR Part 18) require the reporting of FIRMS codes associated with the facility or location where in-bond shipments are physically delivered to at destination (see, 19 CFR 18.1(j)). The FIRMS code submission requirement pertains to in-bond shipments transported via all modes of transportation, except air. Dating from September 2017, when the final rule of the revised Part 18 was published, the reporting of FIRMS codes has not been enforced (i.e., submission of FIRMS code was optional). As of August 10, 2024, the inclusion of FIRMS codes by filers/carriers/brokers in their electronic in-bond arrival reporting is now mandatory. The now active ACE validation for FIRMS code will reject any arrival transaction submitted without a FIRMS code. Such reporting is performed via a CBP-approved electronic data interface: ACE Portal, Multi-Modal Manifest, or Automated Broker Interface (ABI). Additionally, in-bond filers with ACE carrier accounts can use the ACE Manifest Trade In-Bond User Interface to perform their in-bond arrival/update transactions (see CSMS# 54643770, cited below).
How to locate FIRMS codes
With the decommissioning of the Automated Commercial System, the formerly published “ACS Public FIRMS” report was discontinued in 2023. ACE Report TA-003 (Public FIRMS) was deployed in April 2024 to replace the retired ACS Public FIRMS report (see CSMS# 60352712, cited above) and allows users to locate FIRMS codes of facilities and locations within any port of entry or nationally. Information provided by the report includes facility name, facility type, status, and address. TA-003 can be accessed within ACE Reports via the References folder under Public Reports workspace, as follows:

Failure to comply with the requirements of 19 CFR 18.1(j) will result in liquidated damages.
