The Food and Drug Administration (FDA) has created a new Center for Food Safety and Applied Nutrition (CFSAN) Subclass Code for the Industry Codes listed below. The Subclass Code is listed below and is available immediately.
Subclass Code/Description
X/Oxygen Permeable Packaging
Oxygen-permeable packaging should provide a sufficient exchange of oxygen to allow naturally occurring aerobic spoilage organisms on food to grow and spoil the product before C. botulinum toxin is produced under moderate abuse. Packaging with an oxygen transmission rate (OTR) of 10,000 cc/m2/24hrs at 24°C (75°F), or higher is considered to be oxygen-permeable packaging for seafood and is not considered reduced oxygen packaging (ROP).
The new “X” Subclass Code is to be used only for oxygen-permeable packaging such as ‘10K OTR Packaging’, while the “V” Subclass Code is for ROP, such as vacuum packaging (VAC), modified atmosphere packaging (MAP), hermetically sealed containers, sealed plastic or laminated packaging, packing in oil, and other material that is not considered oxygen-permeable
The description of the Subclass Code below is modified to clarify its usage.
Subclass Code – “V”:
Old Description - Vacuum or Modified Atmosphere Packaging
New Description - Vacuum or MAP and other Reduced Oxygen Packaging
Use of Subclass Code V: Packaging where either air has been removed mechanically (vacuum) or manually; the air in the package is replaced by one or more gases, in various concentrations (modified atmosphere packaging), before the package is hermetically sealed; or other forms of reduced oxygen packaging (ROP) such as packing in oil or any manner that reduces the oxygen transmission to potentially unsafe levels. Product is not shelf stable (e.g., requires refrigeration or freezing).
Until now, seafood in oxygen-permeable packaging was assigned the product code container Subclass Code of “V” for vacuum or modified atmosphere packaging. These types of “V” packaging are typically considered reduced oxygen packaging (ROP). However, oxygen-permeable packaging is not ROP, and the “V” subclass was creating confusion.
These Subclass Code changes apply to the Industry Codes listed below.
