BACKGROUND
On March 8, 2018, the President issued Proclamation 9705, (Adjusting Imports of Steel Into the United States), under Section 232 of the Trade Expansion Act of 1962 (the Trade Act), as amended (19 U.S.C. 1862), adjusting the imports of those steel articles by imposing a 25 percent ad valorem tariff and certain quantitative restrictions on such articles imported from countries except Canada and Mexico, effective March 23, 2018.
On January 24, 2020, the President issued Proclamation 9980, (Adjusting Imports of Derivative Aluminum Articles and Derivative Steel Articles Into the United States), adjusting the tariffs imposed by previous proclamations to apply to the derivatives of aluminum articles and steel articles, effective February 8, 2020.
On May 27, 2022, the President issued A Proclamation: Adjusting Imports of Steel Into the United States (Ukraine) | The White House (https://www.whitehouse.gov/briefing-room/presidential-actions/2022/05/27/a-proclamation-adjusting-imports-of-steel-into-the-united-states-ukraine/) suspending Section 232 duties on imports of steel and derivative steel articles from Ukraine for one year, effective June 1, 2022.
The functionality for the suspension of 232 duties on steel and derivative steel articles that are products of Ukraine will be available in the Automated Commercial Environment (ACE) as of June 1, 2022.
GUIDANCE
Effective June 1, 2022, imports of steel articles and derivative steel articles that are products of Ukraine, as referenced in A Proclamation: Adjusting Imports of Steel Into the United States (Ukraine) | The White House, will not be subject to additional duties under HTSUS subheading 9903.80.01 and 9903.80.03 from 12:00 a.m. June 1, 2022, through 11:59 p.m. on June 1, 2023.
FOREIGN TRADE ZONES
Any imports of steel articles that are products of Ukraine admitted into a U.S. foreign trade zone under "privileged foreign status" as defined in 19 CFR 146.41, prior to 12:01 a.m. eastern daylight time on June 1, 2022, shall be subject upon entry for consumption made on or after 12:01 a.m. eastern daylight time on June 1, 2022, to the 25 percent rate of duty imposed by Proclamation 9705, as amended.
