The purpose of this message is to inform you of updates to the ACE Tips for Filing EPA HFCs. The tips sheet is provided to assist importers or their authorized agents with filing obligations related to import regulations for bulk hydrofluorocarbons (HFCs) under the American Innovation and Manufacturing (AIM) Act.
As part of the AIM Act phasedown of HFCs, starting January 1, 2022, there are requirements for imports of HFCs. Specifically, imports of bulk HFCs and HFC blends of any quantity require allowances, subject to limited exceptions. In addition, EPA is requiring information to be electronically filed through ACE no later than 14 days prior to importation.
The updated tips sheet includes the most current Harmonized Tariff Schedule (HTS) codes for HFCs, guidance on how to file required information in ACE, and additional guidance on how to file in ACE for HFC shipments imported for destruction or transformation, or for shipments entering a Foreign Trade Zone (FTZ) or to be transhipped through the United States.
The tips sheet is available on CBP’s website. More information about the AIM Act and EPA’s regulations can be found at: https://www.epa.gov/climate-hfcs-reduction. In addition, a fact sheet for importers can be found here: https://www.epa.gov/system/files/documents/2021-11/hfc-allocation-rule-importer-requirements-fact-sheet.pdf.
