CSMS #50535869 - GUIDANCE: European Union Aluminum Tariff Rate Quota 2022
Please refer to Quota Bulletin QB 22-901 2022 First and Second Period Tariff Rate Quota for Aluminum Articles of European Union Member Countries (https://www.cbp.gov/trade/quota/bulletins/qb-22-901-2022-first-and-second-period-tariff-rate-quota-trq-aluminum-articles-european) which addresses quantity thresholds for January 1, 2022 through June 30, 2022.
The First Period opens on January 3, 2022.
Quota Bulletin 22-901 “First and Second Period TRQ for Aluminum Articles of EU Member Countries” provides instructions to file entries from EU Member Countries of origin for:
- Quota eligible aluminum goods
- Department of Commerce (DOC) approved Individual Importer Product Exclusions
- DOC General Approved Exclusion (GAE) HTS aluminum goods.
- “Over-quota” aluminum goods
Reminder: Effective December 27, 2021 per FRN 2021-26634 the DOC GAE list is updated removing 4 aluminum HTS numbers from GAE status. All GAE HTS numbers can be found at the bottom of the Quota Bulletin.
In alignment with “A Proclamation on Adjusting Imports of Aluminum into the United States” signed December 27, 2021 (https://www.whitehouse.gov/briefing-room/presidential-actions/2021/12/27/a-proclamation-on-adjusting-imports-of-aluminum-into-the-united-states-2/):
Quantitative limitations applicable to imports of aluminum products under HTS subheadings 9903.85.25 through 9903.85.44 for the 2022 quota year are limited on a semi-annual basis.
In order for shipments to be processed for quota on the same day, the entry summary must be filed, entry summary payment date must be on file or scheduled for a future statement, and the conveyance arrived by 4:30 pm in the port of unlading’s local time zone. The official hours for quota processing are established by 19 CFR 132.3.
All entries submitted prior to 8:30 am ET and on January 3, 2022 will be counted in the first opening at 8:30 am ET. If the accepted entry totals for any HTS group submitted prior to the first opening exceed the country limit of that HTS group, they will be prorated.
