CSMS #50516224 - GUIDANCE: Revocation of 30 Section 232 Steel and Aluminum General Approved Exclusions
The purpose of this message is to provide guidance on the Department of Commerce’s (DOC) December 9, 2021 interim final rule revoking 30 previously granted Section 232 General Approved Exclusions (GAEs).
BACKGROUND
On December 14, 2020, DOC’s Bureau of Industry and Security (BIS) published Federal Register (FR) Notice 85 FR 81060, issuing 123 GAEs that excluded 123 entire Harmonized Tariff Schedule (HTS) classifications from Section 232 measures. The exclusions were effective for articles entered for consumption, or withdrawn from warehouse for consumption, on or after December 29, 2020.
On December 9, 2021, BIS issued FR Notice 86 FR 70003, revoking 30 GAEs, 26 of which apply to steel products, and 4 of which apply to aluminum products. The revocations are effective December 27, 2021.
The functionality for the acceptance of the updated GAEs will be available in the Automated Commercial Environment (ACE) as of 7:00 am eastern standard time, December 30, 2021.
GUIDANCE
BIS is revoking 26 GAEs for steel products and 4 GAEs for aluminum products effective December 27, 2021. Thereafter, 93 GAEs will remain in effect and may be used by any importer without quantitative limits. Please review the list of remaining excluded HTS classifications in the attached chart.
When an importer reports an excluded 10-digit HTS classification on an entry summary line, ACE will not require Section 232 duties for that line. To use a GAE, the importer must reference the GAE identifier in the ACE system that corresponds to the steel or aluminum articles being imported. For the GAEs, the GAE identifiers are the excluded 10-digit HTS classifications.
Importers should not report any other Section 232 exclusion number or Chapter 99 Section 232 HTS classification on an entry summary line when importing goods under a GAE.
This guidance only applies to Section 232 duty exclusions under a GAE. Separate guidance will be issued for entry summary reporting requirements for Section 232 quota exclusions under a GAE.
