The National Marine Fisheries Service (NMFS) is aware of three issues that are impacting data submissions, based on the most recent NMFS Implementation Guide (IG) dated February 2020. These issues relate to Highly Migratory Species (HMS), and the Seafood Importation Monitoring Program (SIM).
This CSMS provides trade with guidance for the appropriate resolution of those issues.
As corrections are made to the NMFS ACE programming, filers will receive advance notice via CSMS, and changes will be reflected within the next NMFS IG to be published.
#1. Concerning the valid HMS PG01 “Electronic Image Submitted” indicator to submit:
- If the product is Bluefin tuna AND an eBCD has been submitted; OR, if the product is sharkfin, the “Electronic Image Submitted” field should be left blank.
- Otherwise, a Y is expected.
Providing a code other than Y (or leaving it blank) will result in an error: P56 – INVALID ELEC IMAGE CODE
#2. Concerning the valid SIM Program PG06 “Processing Description” codes to submit:
- The valid codes are: NDR, NFL, NGG, NOT, NRD, NST, NRS
- Invalid codes are: RND, HSO, PD
Providing one of the invalid code will result in an error: PGB – INVALID PRODUCT FORM PER PGA
Filers may use only the seven valid codes until such time as the additional three codes are added to the ACE system as valid.
#3. Concerning the valid HMS “disclaimer” code that can be used for the following two HTS codes (with the NM5 flag), if the product does not contain Bluefin tuna:
- 0304.49.0190 Fish fillets and other fish meat (whether or not minced), fresh, chilled or frozen (90 = Other)
- 0304.87.0000 Tunas, non-specific fillet frozen (of the genus Thunnus), skipjack or stripe-bellied bonito (Euthynnus or Katsuwonus pelamis)
- If the product contained in the Entry is NOT Bluefin tuna, and if it is one of the two HTS codes above, and if a disclaimer code is provided, the disclaim code must be A or B
The A or B disclaimer is appropriate for the NM5 flag if the disclaim codes are used for product that is not fresh Bluefin tuna (or is not other product that is covered by the NMFS HMS program, primarily Bluefin tuna or swordfish).
For NM5, providing a code other than A or B will result in an error: PR9 – INVALID DISCLAIMER CODE PER PGA
