This message includes information on both PRODUCTION FWS PILOT and CERTIFICATION FWS testing.
The Fish and Wildlife Service (FWS) ACE PGA Pilot became available in production as of May 23, 2018 for those filers who are either using an ABI Vendor or Service Center who has tested FWS in the ACE Certification environment, or are a self-programming ABI filer who has completed such testing in Certification. In addition, FWS filers must comply with the Production Pilot steps.
PRODUCTION PILOT STEPS
For Fish and Wildlife Service pilot, once the FWS approved filer has gone through the steps below and is participating at a FWS port, then ALL tariffs that are flagged for FWS data must have ACE PGA data sent on the entry for ACE Cargo Release. This includes either the full ACE PGA FWS message set, or one of two disclaimer codes as part of the ACE PGA FWS data based on the alternate filing method selected (as detailed in the FRN from April 23).
It is very important that the filer identify only the FWS ports where they plan to participate in the FWS pilot.
1. Confirm your ABI vendor/service center has completed Certification testing with FWS and CBP. If you are a self-programming filer, verify with your own company that such testing has been completed.
2. Per the FRN issued on April 23, 20 (https://www.gpo.gov/fdsys/pkg/FR-2018-04-23/pdf/2018-08381.pdf) send an email to lawenforcement@fws.gov with subject “Request to Participate in FWS test.” In the email to Fish and Wildlife Service include the filer name, filer code, the commodities the filer intends to import, and the intended ports of arrival.
3 Include a copy of the email sent to FWS in step 2 above. Send a copy of it to your assigned CBP Client Representative.
Additional information for the email to your Client Representative should include:
• ABI Vendor or Service Provider Name (or identify yourself as Self-Programmed filer)
• Filer Point of Contact Name, email address, and phone number.
4. The initial filings for each filer participating in the pilot will involve a Technical Trace in the Production environment, at a mutually agreed upon time.
• The call will include FWS personnel at the port and HQ level, FWS Technical Team, the filer’s operational and technical people (or ABI vendor), CBP personnel with the ACE PGA Technical Team, CBP Client representatives, and CBP port personnel.
• The filer will provide specific information for the initial filings to include the commodity, port of unlading, port of entry, carrier name, bill of lading or air waybill number, and ETA at the port.
5. Following the technical trace call, FWS must approve that a filer can begin the pilot and continue to file in Production.
ENDING PILOT PARTICIPATION
If at any time, an approved filer decides they do NOT want to participate, they must contact FWS at lawenforcement@fws.gov, and contact their CBP Client representative, with that information, so they can be removed from the database.
REVIEW OF THE PILOT
Ninety days after the start of the pilot, FWS and CBP will review the results of the pilot before extending.
CERTIFICATION PARTICIPATION STEPS
To file in the ACE Certification environment, send an email to your assigned client representative and to lawenforcement@fws.gov that includes the following.
· Filer code
· Filer Name
· FWS Port of Entry Codes
· Point of contact name, email address, and phone number
· ABI vendor or Service Center (or identify at a self-programmer)
Please note that for FWS filing, ALL entries for ACE Cargo Release that include a tariff number that is flagged for FWS data must be filed with either FWS data or a disclaimer code. For this reason, we recommend that you limit the port codes you choose for filing to provide the least disruption to other testing you may be doing that is unrelated to FWS testing.
