Call Your Office TODAY to Apply for Pandemic and Natural Disaster Revenue Loss Programs

The U.S. Department of Agriculture (USDA) Farm Service Agency (FSA) reminds producers of the July 14 deadline to apply for both the Emergency Relief Program (ERP) Phase Two and the Pandemic Assistance Revenue Program (PARP). These revenue-based programs help offset revenue losses from 2020 and 2021 natural disasters or the COVID-19 pandemic. 

ERP and PARP offer a holistic approach to disaster assistance and provide economic support for producers who bear the financial brunt of circumstances beyond their control.  

Eligibility    

To be eligible for ERP Phase Two, producers must have suffered a decrease in allowable gross revenue in 2020 or 2021 due to necessary expenses related to losses of eligible crops from a qualifying natural disaster event. Assistance will be primarily to producers of crops that were not covered by Federal Crop Insurance or NAP, since crops covered by Federal Crop Insurance and NAP were included in the assistance under ERP Phase One.      

To be eligible for PARP, an agricultural producer must have been in the business of farming during at least part of the 2020 calendar year and had a 15% or greater decrease in allowable gross revenue for the 2020 calendar year, as compared to a baseline year.     

FSA offers an online ERP tool and PARP tool that can help producers determine what is considered allowable gross revenue for each respective program. Through cooperative agreements with FSA, nine organizations are also providing free ERP Phase Two application assistance to producers across the United States and territories.  

ERP Phase Two Policy Updates 

USDA recently updated ERP Phase Two to provide a method for valuing losses and accessing program benefits to eligible producers of certain crops, including grapes grown and used by the same producer for wine production or forage that is grown, stored and fed to livestock, that do not generate revenue directly from the sale of the crop. 

The value of the eligible crop intended for on-farm use will be based on the producer’s actual production of the crop and a price for the crop as determined by FSA’s Deputy Administrator for Farm Programs based on the best available data for each crop such as published crop price data or the average price obtained by other producers in the area. Acceptable, published sources including but are not limited to Federal Crop Insurance Corporation established prices, FSA established National Crop Table prices and National Agricultural Statistic Service prices. 

Revenue and pricing guidelines for expected revenue for wine grapes and on-farm forage is available online for producer reference and convenience when applying for ERP Phase Two. 

Requirement to Purchase Crop Insurance or NAP Coverage  

All producers who receive ERP Phase 2 payments must purchase crop insurance, or NAP coverage where crop insurance is not available, in the next two available crop years as determined by the Secretary. Purchased coverage must be at 60/100 level of coverage or higher for insured crops, or at the catastrophic coverage level or higher for NAP crops. 

Crops that are not eligible for crop insurance or NAP are still eligible for ERP Phase Two, but producers must obtain Whole Farm Revenue Protection or Micro Farm Program policy to meet linkage requirements.   

Maximize FSA Office Visits 

Producers should contact their local FSA office to make an appointment to apply for ERP Phase Two and PARP assistance. Producers should also keep in mind that July 15 is a major deadline to complete acreage reports for most crops. FSA encourages producers to complete the ERP Phase Two application, PARP application and acreage reporting during the same office visit.

USDA Reminds State Producers to File Crop Acreage Reports

Agricultural producers in New York who have not yet completed their crop acreage reports after planting should make an appointment with their U.S. Department of Agriculture (USDA) Farm Service Agency (FSA) service center before the applicable deadline.

An acreage report documents a crop grown on a farm or ranch and its intended uses. Filing an accurate and timely acreage report for all crops and land uses, including failed acreage and prevented planted acreage, can prevent the loss of benefits.

How to File a Report

The following acreage reporting dates are applicable in New York:  

Monday, July 17 - Corn, Soybeans, Spring Planted Small Grains and most other crops including CRP and cover crops.

Tuesday, August 15 - Cabbage and Beans

Acreage reporting dates vary by crop and by county. Contact your local FSA office for a list of acreage reporting deadlines by crop.

To file a crop acreage report, producers need to provide:

  • Crop and crop type or variety.
  • Intended use of the crop.
  • Number of acres of the crop.
  • Map with approximate boundaries for the crop.
  • Planting date(s).
  • Planting pattern, when applicable.
  • Producer shares.
  • Irrigation practice(s).
  • Acreage prevented from planting, when applicable.
  • Other information as required. 

Acreage Reporting Details

The following exceptions apply to acreage reporting dates:

  • If the crop has not been planted by the acreage reporting date, then the acreage must be reported no later than 15 calendar days after planting is completed.
  • If a producer acquires additional acreage after the acreage reporting date, then the acreage must be reported no later than 30 calendar days after purchase or acquiring the lease. Appropriate documentation must be provided to the county office.
  • If crops are covered by the Noninsured Crop Disaster Assistance Program, acreage reports should be submitted by the applicable state, county, or crop-specific reporting deadline or 15 calendar days before grazing or harvesting of the crop begins.

Producers should also report crop acreage they intended to plant, but due to natural disaster, were unable to because of a natural disaster.

Prevented planting acreage must be reported on form CCC-576, Notice of Loss, no later than 15 calendar days after the final planting date as established by FSA and USDA’s Risk Management Agency.

FSA offers continuous certification for perennial forage. This means after perennial forage is reported once and the producer elects continuous certification, the certification remains in effect until a change is made. Check with FSA at the local USDA Service Center for more information on continuous certification.

New Option to View, Print and Label Maps on Farmers.gov

Producers with an eAuth account linked to their USDA customer record can now access their FSA farm records, maps and common land units by logging into farmers.gov. A new feature will allow producers to export field boundaries as shapefiles and import and view other shapefiles, such as precision agriculture boundaries. This will allow producers to view, print and label their own maps for acreage reporting purposes. 

Producers who have authority to act on behalf of another customer as a grantee via form FSA-211 Power of Attorney, Business Partner Signature Authority, along with other signature types, or as a member of a business can now access information in the farmers.gov portal.

USDA Offers Assistance to Help Organic Dairy Producers Cover Increased Costs

USDA announced assistance for dairy producers with the new Organic Dairy Marketing Assistance Program (ODMAP). ODMAP is established to help mitigate market volatility, higher input and transportation costs, and unstable feed supply and prices that have created unique hardships in the organic dairy industry. Specifically, under the ODMAP, USDA’s Farm Service Agency (FSA) is making $104 million available to organic dairy operations to assist with projected marketing costs in 2023, calculated using their marketing costs in 2022. Eligible producers include certified organic dairy operations that produce milk from cows, goats and sheep.

How ODMAP Works

FSA is providing financial assistance for a producer’s projected marketing costs in 2023 based on their 2022 costs. ODMAP provides a one-time cost-share payment based on marketing costs on pounds of organic milk marketed in the 2022 calendar year. ODMAP provides financial assistance that will immediately support certified organic dairy operations during 2023 keeping organic dairy operations sustainable until markets return to more normal conditions. 

How to Apply

FSA is accepting applications from May 24 to July 26, 2023. To apply, producers should contact FSA at their local USDA Service Center. To complete the ODMAP application, producers must certify to pounds of 2022 milk production, show documentation of their organic certification, and submit a completed application form.

Organic dairy operations are required to provide their USDA certification of organic status confirming operation as an organic dairy in 2023 and 2022 along with the certification of 2022 milk production in hundredweight.

ODMAP complements other assistance available to dairy producers, including Dairy Margin Coverage (DMC) and Supplemental DMC, with more than $300 million in benefits paid for the 2023 program year to date. Learn more on the FSA Dairy Programs webpage.


Farm Service Agency Now Accepting Nominations for Farmers to Serve on Local County Committees

The U.S. Department of Agriculture (USDA) is now accepting nominations for county committee members for elections that will occur later this year. Additionally, USDA’s Farm Service Agency (FSA) is unveiling a new GIS tool to make it easier for producers to participate in the nomination and election processes for county committee members, who make important decisions on how federal farm programs are administered locally.

All nomination forms for the 2023 election must be postmarked or received in the local FSA office by Aug. 1, 2023.   

Elections will occur in certain Local Administrative Areas (LAA) for members. LAAs are elective areas for FSA committees in a single county or multi-county jurisdiction and they may include LAAs that are focused on an urban or suburban area.

Customers can locate their LAA through a new GIS locator tool available at fsa.usda.gov/elections.

Agricultural producers may be nominated for candidacy for the county committee if they:

  • Participate or cooperate in a USDA program; and
  • Reside in the LAA that is up for election this year.

A cooperating producer is someone who has provided information about their farming or ranching operation to FSA, even if they have not applied or received program benefits. Individuals may nominate themselves or others and qualifying organizations may also nominate candidates. USDA encourages minority producers, women and beginning farmers or ranchers to nominate, vote and hold office.   

Nationwide, more than 7,700 dedicated members of the agricultural community serve on FSA county committees. The committees are made up of three to 11 members who serve three-year terms. Committee members are vital to how FSA carries out disaster programs, as well as conservation, commodity and price support programs, county office employment and other agricultural issues.    

Urban and Suburban County Committees 

The 2018 Farm Bill directed USDA to form urban county committees as well as make other advancements related to urban agriculture, including the establishment of the Office of Urban Agriculture and Innovative Production. FSA established county committees specifically focused on urban agriculture. The urban county committees will work to encourage and promote urban, indoor and other emerging agricultural production practices. Additionally, the new county committees may address areas such as food access, community engagement, support of local activities to promote and encourage community compost and food waste reduction.

Urban committee members are nominated and elected to serve by local urban producers in the same jurisdiction. Urban county committee members will provide outreach to ensure urban producers understand USDA programs and serve as the voice of other urban producers and assist in program implementation that support the needs of the growing urban community.    

County committees for urban agriculture are located in 17 cities across the U.S. including New York City.

Producers should contact their local FSA office today to register and find out how to get involved in their county’s election, including if their LAA is up for election this year. To be considered, a producer must be registered and sign an FSA-669A nomination form. Urban farmers should use an FSA-669-A-3 for urban county committees. The form and other information about FSA county committee elections are available at fsa.usda.gov/elections 

Election ballots will be mailed to eligible voters beginning Nov. 6, 2023.


Financial Assistance Application Process Opens for USDA Farm Loan Borrowers Who Have Faced Discrimination

The U.S. Department of Agriculture (USDA) announced the opening of the financial assistance application process for eligible farmers, ranchers, and forest landowners who experienced discrimination in USDA farm lending programs prior to January 2021. Section 22007 of the Inflation Reduction Act (IRA) directs USDA to provide this assistance. Since the law’s passage, USDA has worked diligently to design the program in accordance with significant stakeholder input. 

The program website, 22007apply.gov, is now open. The website includes an English- and Spanish-language application that applicants can download or submit via an e-filing portal, information on how to obtain technical assistance in-person or virtually, and additional resources and details about the program. 

Farmers, ranchers, and forest landowners who experienced discrimination by USDA in its farm loan programs prior to January 1, 2021 and/or are currently debtors with assigned or assumed USDA farm loan debt that was the subject of USDA discrimination that occurred prior to January 1, 2021, are eligible for this program.  

To apply, borrowers have the option to apply via the e-filing portal at 22007apply.gov or submit paper-based forms via mail or in-person delivery to the program’s local offices. The application process will be open from July 7 to October 31, 2023. Under the planned timeline, applications will be reviewed in November and December, with payments reaching recipients soon thereafter. Importantly, applicants should know that the application process is not on a first come, first served, basis. All applications received or postmarked before the October 31 deadline will be considered. 

To support producers throughout the application process, USDA is ensuring that organizations with extensive experience conducting outreach to farm organizations are able to support individuals who may be eligible for the program. These groups include AgrAbilityFarmer Veteran CoalitionFarmers’ Legal Action GroupFederation of Southern CooperativesIntertribal Agriculture CouncilLand Loss Prevention ProgramNational Young Farmers Coalition, and Rural Coalition.  

Vendors operating four regional hubs are also providing technical assistance and working closely with these and other community-based organizations to conduct outreach using digital and grassroots strategies, to ensure potential applicants are informed about the program and have the opportunity to apply. These hubs are operating a network of brick-and-mortar program offices and will conduct extensive outreach about the program. Windsor Group serves farmers in the eastern regions of the U.S. and Analytic Acquisitions serves the western regions. A national administrator, Midtown Group, is responsible for program oversight and integrity, and will lead a national call-center, operate the application website - 22007apply.gov, which is now open – and review and process applications and payments. All vendors have experience in professional services, supporting government contracts, and complex program operations.   

On March 1, 2023, USDA shared initial details on how the Section 22007 program will work, including that the Inflation Reduction Act specifies the Secretary of Agriculture is responsible for providing this assistance through qualified nongovernmental entities, under standards set by USDA. USDA entered into agreements with vendors and cooperators in May.   

In addition to the Discrimination Financial Assistance Program (DFAP) opening today, the Inflation Reduction Act also created several other programs that are helping USDA rebuild trust, address systemic issues and improve service to people who may have been underserved by USDA in the past. In standing up this program, USDA has become aware of some lawyers and groups spreading misleading information about the discrimination assistance process, pressuring people to sign retainer agreements, and asking people to fill out forms with private and sensitive information. As of today, the official application process has begun and filling out an application is free

No attorneys’ fees will be paid to applicants or their counsel by USDA or by any other agency or department of the United States. The amount of financial assistance will not be increased for those claimants who are represented by an attorney. Applicants are not required to retain an attorney. USDA, the national administrator, and the regional hub vendors will neither recommend that any applicant retain counsel or retain a specific attorney or law firm, nor discourage an applicant from obtaining counsel or using a specific attorney or law firm. USDA Simplifies Application Process for Noninsured Crops for Underserved Producers; Improves Risk Management Accessibility

Earlier this year, Farm Service Agency (FSA) made several updates to disaster assistance programs to give more farmers, ranchers, and Tribes equitable access to recovery programs. Specifically, we made changes to the Noninsured Crop Disaster Assistance Program (NAP) and simplified the application process for underserved producers.

This important policy change opens the door to risk management options for producers who may not have previously known about or been able to obtain coverage to protect their crops.

NAP provides financial assistance to producers of noninsurable crops when natural disaster events cause low yields, loss of inventory, or prevented planting.

Our policy improvements mean that, beginning with the 2022 crop year, having a CCC-860 form, Socially Disadvantaged, Limited Resource, Beginning and Veteran Farmer or Rancher Certification, on file with FSA will provide producers with basic NAP coverage for all eligible crops. Specifically, FSA is waiving all NAP-related service fees for basic coverage for producers with a CCC-860 on file prior to the application closing date for each crop. These producers are also eligible to receive a 50% premium reduction if they elect higher levels of coverage before the application closing date for each crop.

At the end of January, FSA notified producers who already have the CCC-860 certification form on file regarding their eligibility for NAP basic coverage for 2022. If you suffered losses from natural disasters in 2022, you will need to contact your local FSA county office to file an acreage report, as well as a notice of loss, and an application for a NAP payment.

If you are interested in NAP coverage for 2023 and future years, your local FSA county office staff will be more than happy to provide information on eligibility, coverage options, and how to apply for additional coverage. 

While these recent policy changes are intended to remove barriers to available benefits and help underserved producers manage risk, any producer of noninsurable crops can apply for NAP coverage by completing FSA form CCC-471, Application for Coverage, and paying a service fee. Your local FSA office can verify application closing dates and ensure coverage for your crops is available.

FSA is committed to revisiting program policies and finding ways, within our authorities, to remove obstacles that prevent participation. Expanding NAP to ensure all producers of noninsured crops have access to risk coverage is the result of proactive input from producers and the willingness of FSA employees to think outside of the box for the benefit of the producers we serve.

FSA Offers Joint Financing Option on Direct Farm Ownership Loans

The USDA Farm Service Agency’s (FSA) Direct Farm Ownership loans can help farmers and ranchers become owner-operators of family farms, improve and expand current operations, increase agricultural productivity, and assist with land tenure to save farmland for future generations.

There are three types of Direct Farm Ownership Loans: regular, down payment and joint financing. FSA also offers a Direct Farm Ownership Microloan option for smaller financial needs up to $50,000.

Joint financing allows FSA to provide more farmers and ranchers with access to capital. FSA lends up to 50 percent of the total amount financed. A commercial lender, a State program or the seller of the property being purchased, provides the balance of loan funds, with or without an FSA guarantee. The maximum loan amount for a joint financing loan is $600,000, and the repayment period for the loan is up to 40 years.

The operation must be an eligible farm enterprise. Farm Ownership loan funds cannot be used to finance nonfarm enterprises and all applicants must be able to meet general eligibility requirements. Loan applicants are also required to have participated in the business operations of a farm or ranch for at least three years out of the 10 years prior to the date the application is submitted. The applicant must show documentation that their participation in the business operation of the farm or ranch was not solely as a laborer.

Applying for Farm Storage Facility Loans

The Farm Service Agency’s (FSA) Farm Storage Facility Loan (FSFL) program provides low-interest financing to help you build or upgrade storage facilities and to purchase portable (new or used) structures, equipment and storage and handling trucks.

Eligible commodities include corn, grain sorghum, rice, soybeans, oats, peanuts, wheat, barley, minor oilseeds harvested as whole grain, pulse crops (lentils, chickpeas and dry peas), hay, honey, renewable biomass, fruits, nuts and vegetables for cold storage facilities, floriculture, hops, maple sap and syrup, rye, milk, cheese, butter, yogurt, meat and poultry (unprocessed), eggs, and aquaculture (excluding systems that maintain live animals through uptake and discharge of water). Qualified facilities include grain bins, hay barns and cold storage facilities for eligible commodities.  

Loans up to $50,000 can be secured by a promissory note/security agreement, loans between $50,000 and $100,000 may require additional security, and loans exceeding $100,000 require additional security.

You do not need to demonstrate the lack of commercial credit availability to apply. The loans are designed to assist a diverse range of farming operations, including small and mid-sized businesses, new farmers, operations supplying local food and farmers markets, non-traditional farm products, and underserved producers.

USDA Announces Historic Investment in Wildlife Conservation, Expands Partnership to Include Additional Programs

USDA is expanding its work on wildlife conservation by investing at least $500 million over the next five years and by leveraging all available conservation programs, including the Conservation Reserve Program (CRP), through its Working Lands for Wildlife (WLFW) effort. These commitments will ramp up the conservation assistance for farmers, ranchers, private forest owners and tribes with a focus on working lands in key geographies across the country as well as hiring for key conservation positions.

The funding will help deliver a series of cohesive Frameworks for Conservation Action, which establish a common vision across the partnership of public and private interests and goals for delivering conservation resources in a given ecosystem, combining cutting-edge science with local knowledge.

The new funding includes $250 million from the Agricultural Conservation Easement Program (ACEP) and $250 million from the Environmental Quality Incentives Program (EQIP).  This announcement builds off more than a decade of growing Farm Bill investments in wildlife habitat, and serves as a roadmap to leveraging both Farm Bill funding and the historic investments from the Inflation Reduction Act to guide conservation efforts. USDA’s Natural Resources Conservation Service (NRCS) and Farm Service Agency (FSA) will coordinate this work through WLFW, which focuses on voluntary, locally-led efforts that benefit wildlife and agricultural communities.    

This funding will immediately benefit two of WLFW’s newest priorities. In the western U.S., at least $40 million of EQIP and ACEP funding will go toward USDA’s ongoing efforts to help conserve migratory big game habitat, allowing a continuation of an existing partnership with the state of Wyoming and an expansion to the neighboring states of Idaho and Montana. In 25 central and eastern U.S. states, an additional $14 million in new EQIP funding will be dedicated to conservation of bobwhite quail and associated species in the grasslands and savannas of the central and eastern U.S. Additionally, Inflation Reduction Act funding will also build outcomes for northern bobwhite recovery as over 3.5 million acres will help mitigate greenhouse gases.  

About USDA’s Working Lands for Wildlife   

WLFW is USDA’s premier approach for conserving American working lands to benefit people, wildlife and rural communities. While NRCS and FSA work every day at all levels to assist producers, states, tribes and other conservation partners with their conservation priorities, WLFW steps in to facilitate their work on cross-cutting, national priorities that can only be addressed through coordination at an ecosystem scale.    

Established in 2010, WLFW has teamed up with leading scientists and conservation partners as well as more than 8,400 producers to conserve or restore nearly 12 million acres of working lands, with tremendous benefits. WLFW has helped many sensitive species in their recovery, including the greater sage-grouse in the West, New England cottontail in the Northeast, golden-winged warbler in Appalachia and gopher tortoise in the Southeast. In large part because of the voluntary conservation efforts on private lands though WLFW, the U.S. Fish and Wildlife Service has in some cases determined that species listing under the Endangered Species Act (ESA) was no longer warranted thanks to recoveries made possible by these WLFW efforts.
