FSA State Executive Director- Monthly Message

No doubt about it – April was a tough month in ND!  Back-to-back blizzards in western and central ND – plus ice in the NW corner that took out lots of power poles and lines – added to significant rain falling on the eastern side which caused overland flooding in some areas – severe thunderstorms, tornado touchdown, and hail – all in one month!  It’s a good thing that North Dakotan’s are hardy!  We take everything that Mother Nature throws at us, shake our heads, and then we roll up our sleeves and get back to work.  Here’s something to make you smile – I’ve been visiting FSA county offices and meeting with our hard working, professional staff.  I always ask what their favorite thing is about working for the Farm Service Agency.  Almost universally, they tell me it is working with “their” producers like you are part of their family. They look forward to seeing you come in the door, visiting with you, and helping you. You are valued!

The Emergency Relief Program (ERP) was just announced by Secretary Vilsack on Monday. This program will bring significant dollars to many ND producers. Pre-filled applications are being mailed from Kansas City the week of May 23rd so please watch for those letters. The applications must be signed and turned into the county office by July 22nd.  More information is available about this program below.

Now, here’s hoping that April blizzards, thunderstorms, heavy rains, hail and showers will bring May flowers, green grass and germinating crops.

USDA to Provide $6 billion to Commodity and Specialty Crop Producers Impacted by 2020 and 2021 Natural Disasters

First Wave of Payments Based on Crop Insurance Data

The U. S Department of Agriculture (USDA) today announced that commodity and specialty crop producers impacted by natural disaster events in 2020 and 2021 will soon begin receiving emergency relief payments totaling approximately $6 billion through the Farm Service Agency’s (FSA) new Emergency Relief Program (ERP) to offset crop yield and value losses. 

Background  
On September 30, 2021, President Biden signed into law the Extending Government Funding and Delivering Emergency Assistance Act (P.L. 117-43), which includes $10 billion in assistance to agricultural producers impacted by wildfires, droughts, hurricanes, winter storms, and other eligible disasters experienced during calendar years 2020 and 2021. FSA recently made payments to ranchers impacted by drought and wildfire through the first phase of the Emergency Livestock Relief Program (ELRP). ERP is another relief component of the Act.  

For impacted producers, existing Federal Crop Insurance or Noninsured Crop Disaster Assistance Program (NAP) data is the basis for calculating initial payments. USDA estimates that phase one ERP benefits will reach more than 220,000 producers who received indemnities for losses covered by federal crop insurance and more than 4,000 producers who obtained NAP coverage for 2020 and 2021 crop losses.   

ERP Eligibility – Phase One  
ERP covers losses to crops, trees, bushes, and vines due to a qualifying natural disaster event in calendar years 2020 and 2021.  Eligible crops include all crops for which crop insurance or NAP coverage was available, except for crops intended for grazing. Qualifying natural disaster events include wildfires, hurricanes, floods, derechos, excessive heat, winter storms, freeze (including a polar vortex), smoke exposure, excessive moisture, qualifying drought, and related conditions.  

For drought, ERP assistance is available if any area within the county in which the loss occurred was rated by the U.S. Drought Monitor as having a: 

  • D2 (severe drought) for eight consecutive weeks; or 
  • D3 (extreme drought) or higher level of drought intensity. 

Lists of 2020 and 2021 drought counties eligible for ERP is available on the emergency relief website. 

To streamline and simplify the delivery of ERP phase one benefits, FSA will send pre-filled application forms to producers where crop insurance and NAP data are already on file. This form includes eligibility requirements, outlines the application process and provides ERP payment calculations. Producers will receive a separate application form for each program year in which an eligible loss occurred. Receipt of a pre-filled application is not confirmation that a producer is eligible to receive an ERP phase one payment. 

Additionally, producers must have the following forms on file with FSA within 60 days of the ERP phase one deadline, which will later be announced by FSA’s Deputy Administrator for Farm Programs:  

  • Form AD-2047, Customer Data Worksheet.
  • Form CCC-902, Farm Operating Plan for an individual or legal entity.   
  • Form CCC-901, Member Information for Legal Entities (if applicable).   
  • Form FSA-510, Request for an Exception to the $125,000 Payment Limitation for Certain Programs (if applicable).   
  • Form CCC-860, Socially Disadvantaged, Limited Resource, Beginning and Veteran Farmer or Rancher Certification, if applicable, for the 2021 program year.   
  • A highly erodible land conservation (sometimes referred to as HELC) and wetland conservation certification (Form AD-1026 Highly Erodible Land Conservation (HELC) and Wetland Conservation (WC) Certification) for the ERP producer and applicable affiliates.  

Most producers, especially those who have previously participated in FSA programs, will likely have these required forms on file. However, those who are uncertain or want to confirm the status of their forms can contact their local FSA county office.    

ERP Payment Calculations – Phase One  
For crops covered by crop insurance, the ERP phase one payment calculation for a crop and unit will depend on the type and level of coverage obtained by the producer.   Each calculation will use an ERP factor based on the producer’s level of crop insurance or NAP coverage.  

  • Crop Insurance – the ERP factor is 75% to 95% depending on the level of coverage ranging from catastrophic to at least 80% coverage. 
  • NAP – the ERP factor is 75% to 95% depending on the level of coverage ranging from catastrophic to 65% coverage.      

Full ERP payment calculation factor tables are available on the emergency relief website and in the program fact sheet.

Applying ERP factors ensures that payments to producers do not exceed available funding and that cumulative payments do not exceed 90% of losses for all producers as required by the Act.   

Also, there will be certain payment calculation considerations for area plans under crop insurance policies.     

The ERP payment percentage for historically underserved producers, including beginning, limited resource, socially disadvantaged, and veteran farmers and ranchers will be increased by 15% of the calculated payment for crops having insurance coverage or NAP.  

To qualify for the higher payment percentage, eligible producers must have a CCC-860, Socially Disadvantaged, Limited Resource, Beginning and Veteran Farmer or Rancher Certification, form on file with FSA for the 2021 program year.   

Because the amount of loss due to a qualifying disaster event in calendar years 202 and 2021 cannot be separated from the amount of loss caused by other eligible causes of loss as defined by the applicable crop insurance or NAP policy, the ERP phase one payment will be calculated based on the producer’s loss due to all eligible causes of loss.  

Future Insurance Coverage Requirements 
All producers who receive ERP phase one payments, including those receiving a payment based on crop, tree, bush, or vine insurance policies, are statutorily required to purchase crop insurance, or NAP coverage where crop insurance is not available, for the next two available crop years, as determined by the Secretary.  Participants must obtain crop insurance or NAP, as may be applicable: 

  • At a coverage level equal to or greater than 60% for insurable crops; or 
  • At the catastrophic level or higher for NAP crops. 

Coverage requirements will be determined from the date a producer receives an ERP payment and may vary depending on the timing and availability of crop insurance or NAP for a producer’s particular crops.  The final crop year to purchase crop insurance or NAP coverage to meet the second year of coverage for this requirement is the 2026 crop year.  

Emergency Relief – Phase Two (Crop and Livestock Producers) 
Today’s announcement is only phase one of relief for commodity and specialty crop producers.  Making the initial payments using existing safety net and risk management data will both speed implementation and further encourage participation in these permanent programs, such as Federal crop insurance, as Congress intended.  

The second phase of both ERP and ELRP programs will fill gaps and cover producers who did not participate in or receive payments through the existing programs that are being leveraged for phase one implementation.  When phase one payment processing is complete, the remaining funds will be used to cover gaps identified under phase two.    

Through proactive communication and outreach, USDA will keep producers and stakeholders informed as program details are made available.   More information on ERP can be found in the Notice of Funding Availability.

Additional Commodity Loss Assistance  
The Milk Loss Program and On-Farm Stored Commodity Loss Program are also funded through the Extending Government Funding and Delivering Emergency Assistance Act and will be announced in a future rule in the Federal Register.

USDA Accepts 2 Million Acres in Conservation Reserve Program General Signup

Agriculture Secretary Tom Vilsack announced the U.S. Department of Agriculture (USDA) is accepting more than 2 million acres in offers from agricultural producers and landowners through the Conservation Reserve Program (CRP) General signup, which included nearly 77,000 acres in North Dakota. This is the first of the program’s multiple signups occurring in 2022. With about 3.4 million acres expiring this year, Vilsack encourages producers and landowners to consider the Grassland and Continuous signups, both of which are currently open.  

Producers submitted re-enrollment offers for just over half of expiring acres, similar to the rate in 2021. Offers for new land under General CRP were considerably lower compared to last year’s numbers, with fewer than 400,000 acres being offered this year versus over 700,000 acres offered last year. 

It is important to note that submitting and accepting a CRP offer is the start of the process, and producers still need to develop a conservation plan before enrolling their land on October 1, 2022. Each year, during the window between offer acceptance and land enrollment, some producers change their mind and ultimately decide not to enroll some accepted acres without penalty.

The three other types of CRP — Grassland, Continuous, and CREP — are still available for either working-lands or targeted, often smaller sub-field, offers. Producers have submitted offers on nearly 260,000 acres through the Continuous and CREP signup so far this year. The Grassland signup – which last year had its highest participation ever – closes May 13, 2022. 

General CRP Signup 
The General CRP Signup 58 ran from Jan. 31 to March 11, 2022.  

Through CRP, producers and landowners establish long-term, resource-conserving plant species, such as approved grasses or trees, to control soil erosion, improve soil health and water quality, and enhance wildlife habitat on agricultural land. In addition to the other well-documented benefits, lands enrolled in CRP are playing a key role in climate change mitigation efforts across the country.  

In 2021, FSA introduced improvements to the program, which included a new Climate-Smart Practice Incentive to increase carbon sequestration and reduce greenhouse gas emissions. This incentive provides a 3%, 5% or 10% incentive payment based on the predominant vegetation type for the practices enrolled – from grasses to trees to wetland restoration.

2021 Crop Commodity Loan Deadline

Producers planning to use the commodity loan program for their 2021 crops are reminded that May 31, 2022, is the deadline for filing applications for the following 2021 crops: corn, dry peas, grain sorghum, lentils, mustard, safflower, chickpeas, soybeans and sunflowers.

These loans carry a nine-month maturity and can be repaid with cash at disbursement to loan maturity. To be eligible, producers must have produced an eligible loan commodity for the applicable crop year, complied with annual program requirements, maintain beneficial interest (have title to the commodity and retain control of the commodity), request MAL on or before the final loan availability date for a specific commodity, and, if required, submit lien waivers for any liens existing on the crop for which MAL is being requested.

Producers interested in a commodity loan on the above listed commodities should contact their local county FSA office staff prior to the May 31 deadline.


Crop Year 2022 Commodity Loan Rates

USDA’s Commodity Credit Corporation has announced the 2022 marketing assistance loan rates for wheat, corn, grain sorghum, barley, oats, soybeans and each “other oilseed” (canola, crambe, flaxseed, mustard seed, rapeseed, safflower, sesame seed and sunflower seed) and pulse crops.

Disaster Assistance for 2022 Livestock Forage Losses

Producers in Divide, Williams, McKenzie, Golden Valley and Billings Counties are eligible to apply for 2022 Livestock Forage Disaster Program (LFP) benefits on small grain, native pasture, improved pasture, annual ryegrass and forage sorghum. Certain commodities listed above not planted yet, but if planted with the intent of grazing would be eligible if the County is in a D3 drought status.

LFP provides compensation to eligible livestock producers who suffer grazing losses for covered livestock due to drought on privately owned or cash leased land, or fire on federally managed land.

County committees can only accept LFP applications after notification is received by the National Office of a qualifying drought or if a federal agency prohibits producers from grazing normal permitted livestock on federally managed lands due to qualifying fire.  Eligible livestock producers must complete a CCC-853 and the required supporting documentation no later than Jan. 30, 2023, for 2022 losses.

USDA Accepting Applications to Help Cover Costs of Organic, Transitioning Producers

Applications for the Organic and Transitional Education Certification Program (OTECP) and Organic Certification Cost Share Program (OCCSP) due October 31, 2022

Agricultural producers and handlers who are certified organic, along with producers and handlers who are transitioning to organic production, can now apply for the U.S. Department of Agriculture’s (USDA) Organic and Transitional Education Certification Program (OTECP) and Organic Certification Cost Share Program (OCCSP), which help producers and handlers cover the cost of organic certification, along with other related expenses. Applications for OTECP and OCCSP are both due October 31, 2022. 

OTECP covers:  

  • Certification costs for organic producers and handlers (25% up to $250 per category). 
  • Eligible expenses for transitional producers, including fees for pre-certification inspections and development of an organic system plan (75% up to $750). 
  • Registration fees for educational events (75% up to $200). 
  • Soil testing (75% up to $100).  

Meanwhile, OCCSP covers 50% or up to $500 per category of certification costs in 2022.  

This cost share for certification is available for each of these categories: crops, wild crops, livestock, processing/handling and State organic program fees.   

Producers can receive cost share through both OTECP and OCCSP. Both OTECP and OCCSP cover costs incurred from October 1, 2021, to September 30, 2022.  Producers have until October 31, 2022 to file applications, and FSA will make payments as applications are received.  

To apply, producers and handlers should contact the Farm Service Agency (FSA) at their local USDA Service Center. As part of completing the OCCSP applications, producers and handlers will need to provide documentation of their organic certification and eligible expenses. Organic producers and handlers may also apply for OCCSP through participating State agencies.

USDA To Compensate Drought-Stricken Ranchers for Above Normal Costs to Haul Livestock to Forage

Due to the persistent drought conditions in the Great Plains and West, the U.S. Department of Agriculture (USDA) is offering additional relief through the Emergency Assistance for Livestock, Honeybees and Farm-raised Fish Program (ELAP) to help ranchers cover above normal costs of hauling livestock to forage or other grazing acres. This policy enhancement complements previously announced ELAP compensation for hauling feed to livestock.  ELAP livestock and feed hauling assistance is retroactive for 2021 and will be available for losses in 2022 and subsequent years.   

ELAP Assistance Overview  
ELAP provides financial assistance to eligible producers of livestock, honeybees and farm-raised fish for losses due to disease, certain adverse weather events or loss conditions as determined by the Secretary of Agriculture. In addition to ELAP covering feed transportation costs where grazing and hay resources have been depleted, ELAP now also covers transportation costs associated with hauling livestock to feed sources This includes places where:  

  • Drought intensity is D2 for eight consecutive weeks as indicated by the U.S. Drought Monitor; or  
  • Drought intensity is D3 or greater.  

Additionally, FSA has updated ELAP policy to also cover water hauling in areas experiencing D2 for eight consecutive weeks, lowering the drought intensity threshold (previously D3) triggering the availability of this financial assistance. 

Eligibility  
To be eligible for ELAP assistance, livestock must be intended for grazing and producers must have incurred feed or livestock transportation costs on or after Jan. 1, 2021. Although producers will self-certify losses and expenses to FSA, producers are encouraged to maintain good records and retain receipts and related documentation in the event these documents are requested for review by the local FSA County Committee.   

Payment Calculations  
USDA will reimburse eligible ranchers 60% of livestock transportation costs above what would have been incurred in a normal year. Producers qualifying as underserved (socially disadvantaged, limited resource, beginning or military veteran) will be reimbursed for 90% of the feed transportation cost above what would have been incurred in a normal year.  

 USDA uses a national cost formula to determine reimbursement costs that will not include the first 25 miles and distances exceeding 1,000 transportation miles. The calculation will also exclude the normal cost to transport hay or feed if the producer normally purchases some feed.  For 2021, the initial cost formula of $6.60 per mile will be used (before the percentage is applied).   

Online Decision Tool  
Producers can use the updated ELAP Feed Livestock Transportation Producer Tool to help producers document and estimate payments to cover both feed and livestock transportation costs caused by drought. The tool (a Microsoft Excel workbook) and other resources are available at fsa.usda.gov/elap. Final payments may vary depending on eligibility. 

Eligible ranchers should contact their FSA county office to apply for ELAP assistance. To simplify the application process, ranchers can print, or email payment estimates generated by the online tool for submission to FSA. The deadline to request ELAP assistance for hauling livestock to forage in 2021 is June 30, 2022.  The deadline to request all ELAP assistance for 2022 calendar year losses will be Jan. 31, 2023.

USDA Offers Water Quality-Focused Program That Builds on CRP Contracts

The U.S. Department of Agriculture (USDA) is announcing the signup period for its Clean Lakes, Estuaries, And Rivers initiative (CLEAR30) — a nationwide opportunity for certain landowners and agricultural producers currently implementing water quality practices through the Conservation Reserve Program (CRP) to enroll in 30-year contracts, extending the lifespan and strengthening the benefits of important water quality practices on their land.  

Producers may apply for CLEAR30, a voluntary, incentive-based conservation program, from April 1, 2022, through Aug. 5, 2022.   

Cropland and certain pastureland currently enrolled in Continuous CRP or the Conservation Reserve Enhancement Program (CREP) and dedicated to an eligible water quality practice such as riparian buffers, contour strips, grass waterways or wetland restoration may be eligible if their contracts are expiring by September 30, 2022.  

CLEAR30 contracts will be effective beginning Oct. 1, 2022. These long-term contracts ensure that conservation practices remain in place for 30 years, which improves water quality through reducing sediment and nutrient runoff and helping prevent algal blooms. Conservation in riparian areas also provides important carbon sequestration benefits. Traditional CRP contracts run from 10 to 15 years. 

About CLEAR30 
CLEAR30 was established in the 2018 Farm Bill to better address water quality concerns. Originally, CLEAR30 was only available in the Great Lakes and Chesapeake Bay watersheds; in 2021, FSA made CLEAR30 available to agricultural producers and landowners nationwide, and participation grew nearly seven-fold from 2020 to 2021. 

Annual rental payments for landowners who enroll in CLEAR30 will be equal to the current Continuous CRP annual payment rate plus a 20 percent water quality incentive payment and an annual rental rate adjustment of 27.5 percent.  

How to Sign Up 
To sign up for CLEAR30, landowners and producers should contact their local USDA Service Center by Aug. 5, 2022.  Contact information can be found at farmers.gov/service-locator. Additionally, fact sheets and other resources are available at fsa.usda.gov/crp.

USDA Reminds Producers to File Crop Acreage Reports

Agricultural producers who have not yet completed their crop acreage reports after spring planting should make an appointment with their local County Farm Service Agency (FSA) before the applicable deadline.

An acreage report documents a crop grown on a farm or ranch and its intended uses. Filing an accurate and timely acreage report for all crops and land uses, including failed acreage and prevented planted acreage, can prevent the loss of benefits.

How to File a Report
July 15th, 2022 is the North Dakota Acreage Reporting Deadline for 2022 Crop Year spring planted crops and perennial forage crops.   

Service Center staff continue to work with agricultural producers via phone, email, and other digital tools. Because of the pandemic, some  USDA Service Centers are open to limited visitors. Contact the local County FSA office to set up an in-person or phone appointment.

To file a crop acreage report, you will need to provide:

  • Crop and crop type or variety.
  • Intended use of the crop.
  • Number of acres of the crop.
  • Map with approximate boundaries for the crop.
  • Planting date(s).
  • Planting pattern, when applicable.
  • Producer shares.
  • Irrigation practice(s).
  • Acreage prevented from planting, when applicable.
  • Other information as required.
  • Acreage Reporting Details

The following exceptions apply to acreage reporting dates:

  • If the crop has not been planted by the acreage reporting date, then the acreage must be reported no later than 15 calendar days after planting is completed.
  • If a producer acquires additional acreage after the acreage reporting date, then the acreage must be reported no later than 30 calendar days after purchase or acquiring the lease. Appropriate documentation must be provided to the county office.

Producers should also report crop acreage they intended to plant, but due to natural disaster, were unable to plant. Prevented planting acreage must be reported on form CCC-576, Notice of Loss, no later than 15 calendar days after the final planting date as established by FSA and USDA’s Risk Management Agency.

Noninsured Crop Disaster Assistance Program (NAP) policy holders should note that the acreage reporting date for NAP-covered crops is the earlier of the dates listed above or 15 calendar days before grazing or harvesting of the crop begins.

Policy Updates for Acreage Reporting

The USDA Farm Service Agency (FSA) recently made several policy updates for acreage reporting for cover crops, revising intended use, late-filed provisions, as well as updated the definitions of “idle” and “fallow.”

Reporting Cover Crops:
Cover crop types can be chosen from the following four categories:

  • Cereals and other grasses
  • Legumes
  • Brassicas and other broadleaves
  • Mixtures

If the cover crop is harvested for any use other than forage or grazing and is not terminated according to policy guidelines, then that crop will no longer be considered a cover crop and the acreage report must be revised to reflect the actual crop.

Permitted Revision of Intended use After Acreage Reporting Date:
New operators or owners who pick up a farm after the acreage reporting deadline has passed and the crop has already been reported on the farm, have 30 calendar days from the date when the new operator or owner acquired the lease on land, control of the land or ownership and new producer crop share interest in the previously reported crop acreage. Under this policy, appropriate documentation must be provided to the County Committee’s satisfaction to determine that a legitimate operator or ownership and producer crop share interest change occurred to permit the revision.

Acreage Reports:
In order to maintain program eligibility and benefits, you must timely file acreage reports. Failure to file an acreage report by the crop acreage reporting deadline may result in ineligibility for future program benefits. FSA will not accept acreage reports provided more than a year after the acreage reporting deadline.

Definitions of Terms:
FSA defines “idle” as cropland or a balance of cropland within a Common Land Unit (CLU) (field/subfield) which is not planted or considered not planted and does not meet the definition of fallow or skip row.

Fallow is considered unplanted cropland acres which are part of a crop/fallow rotation where cultivated land that is normally planted is purposely kept out of production during a regular growing season.

2022 Avian Influenza in the United States - What you need to know!

To date, USDA’s National Veterinary Services Laboratories has confirmed the presence of Highly Pathogenic Avian Influenza (HPAI) in commercial and backyard flocks in several states including North Dakota. Avian influenza viruses are classified as either “low pathogenic (LPAI)” or “highly pathogenic (HPAI)” based on their genetic features and the severity of the disease they cause in poultry. Caused by an influenza type A virus, HPAI can infect poultry (such as chickens, turkeys, pheasants, quail, domestic ducks, geese, and guinea fowl) and wild birds (especially waterfowl).  

The clinical signs of birds affected with all forms of Avian Influenza may show one or more of the following: 

  • Sudden death without clinical signs 
  • Decreased water consumption up to 72 hours before other clinical signs 
  • Lack of energy and appetite 
  • Decreased egg production 
  • Soft–shelled or misshapen eggs 
  • Swelling of the head, eyelids, comb, wattles, and hocks 
  • Purple discoloration of the wattles, combs, and legs 
  • Nasal discharge 
  • Coughing, sneezing 
  • Lack of coordination 
  • Diarrhea 

In addition to the disease infecting domestic birds, it is important to know that wild birds can also be infected and show no signs of illness. They can carry the disease to new areas when migrating, potentially exposing domestic poultry to the virus. The APHIS’ wild bird surveillance program provides an early warning system for the introduction and distribution of avian influenza viruses of concern in the United States, allowing APHIS and the poultry industry to take timely and rapid action. 

With the recent detections of avian influenza in wild birds and domestic poultry in the United States, bird owners should review their biosecurity practices and stay vigilant to protect poultry and pet birds from transmission of this disease. The following bio-safety guidelines are effective methods for safeguarding commercial operations and smaller flocks:  

  • Backyard flock owners should practice strict biosecurity, including preventing birds from exposure and/or co-mingling with wild birds and other types of poultry. 
  • Shower, change clothes, and clean and disinfect footwear before entering your poultry housing areas. 
  • Respiratory protection such as a medical facemask would also be important and remember to always wear clean clothes when encountering healthy domestic birds. 
  • Carefully follow safe entry and exit procedures into your flock’s clean area. 
  • Reduce the attractiveness for wild birds to stop at your place by cleaning up litter and spilled feed around poultry housing areas. 
  • If you have free range guinea fowl and waterfowl, consider bringing them into coops or flight pens under nets to prevent interaction of domesticated poultry with wild birds and their droppings. 
  • It is best to restrict visitors from interacting with your birds currently. 
  • Do not touch sick or dead wildlife and keep them away from domestic poultry 
  • Try not to handle sick or deceased domestic birds (if you must, use proper personal protective equipment to minimize direct contact and cautiously disinfect anything that comes into contact with the deceased and or sick bird). 

As part of the existing USDA Avian Influenza response plans, Federal and State partners as well as industry are responding quickly and decisively to these outbreaks by following these five basic steps: 

  • Quarantine – restricting movement of poultry and poultry-moving equipment into and out of the control area;  
  • Eradicate – depopulate the affected flock(s);  
  • Monitor region – testing wild and domestic birds in a broad area around the quarantine area;  
  • Disinfect – kills the virus in the affected flock locations; and  
  • Test – confirming that the poultry farm is AI virus-free.   

Sick or deceased domestic birds should be reported to your local veterinarian. Positive domestic cases are handled by APHIS and its partners. States that have confirmed cases of Avian Influenza should work closely with USDA-APHIS on surveillance, reporting and control efforts.  Disposal methods will be evaluated on a case-by-case basis depending on a variety of factors, including the size of the flock, space requirements, associated costs, local conditions, and applicable laws/regulations.  

The United States has the strongest Avian Influenza surveillance program in the world, where we actively look for the disease and provide fair market value compensation to affected producers to encourage reporting.

According to the Centers for Disease Control, this strain of Avian Influenza is a low risk to the public. While the transmission rate from animals to humans is low, it is a zoonotic disease, meaning it can be shared between species. USDA Updates Farm Loan Programs to Increase Equity

The U.S. Department of Agriculture (USDA) is updating its farm loan programs to better support current borrowers, including historically underserved producers. These improvements are part of USDA’s commitment to increase equity in all programs, including farm loans that provide important access to capital for covering operating expenses and purchasing land and equipment.  

The 2018 Farm Bill authorized FSA to provide equitable relief to certain direct loan borrowers, who are non-compliant with program requirements due to good faith reliance on a material action of, advice of, or non-action from an FSA official. Previously, borrowers may have been required to immediately repay the loan or convert it to a non-program loan with higher interest rates, less favorable terms, and limited loan servicing.  

Now, FSA has additional flexibilities to assist borrowers in such situations. If the agency provided incorrect guidance to an existing direct loan borrower, the agency may provide equitable relief to that borrower. FSA may assist the borrower by allowing the borrower to keep their loans at current rates or other terms received in association with the loan which was determined to be noncompliant or the borrower may receive other equitable relief for the loan as the Agency determines to be appropriate.

USDA encourages producers to reach out to their local loan officials to ensure they fully understand the wide range of loan and servicing options available that can assist them in starting, expanding or maintaining their operation.  

Additional Updates  

Equitable relief is one of several changes authorized by the 2018 Farm Bill that USDA has made to the direct and guaranteed loan programs. Other changes that were previously implemented include:  

  • Modifying the existing three-year farming experience requirement for Direct Farm Ownership loans to include additional items as acceptable experience. 
  • Allowing socially disadvantaged and beginning farmer applicants to receive a guarantee equal to 95%, rather than the otherwise applicable 90% guarantee. 
  • Expanding the definition of and providing additional benefits to veteran farmers. 
  • Allowing borrowers who received restructuring with a write down to maintain eligibility for an Emergency loan. 
  • Expanding the scope of eligible issues and persons covered under the agricultural Certified Mediation Program.

More Background 

FSA has taken other recent steps to increase equity in its programs. Last summer, USDA announced it was providing $67 million in competitive loans through its new Heirs’ Property Relending Program to help agricultural producers and landowners resolve heirs’ land ownership and succession issues. FSA also invested $4.7 million to establish partnerships with organizations to provide outreach and technical assistance to historically underserved farmers and ranchers, which contributed to a fourfold increase in participation by historically underserved producers in the Coronavirus Food Assistance Program 2 (CFAP 2), a key pandemic assistance program, since April 2021. 

Additionally, in January 2021, Secretary Vilsack announced a temporary suspension of past-due debt collection and foreclosures for distressed direct loan borrowers due to the economic hardship imposed by the COVID-19 pandemic. 

Producers can explore available loan options using the Farm Loan Discover Tool on farmers.gov (also available in Spanish) or by contacting their local USDA Service Center. Service Center staff continue to work with agricultural producers via phone, email, and other digital tools. Due to the pandemic, some USDA Service Centers are open to limited visitors. Producers can contact their local Service Center to set up an in-person or phone appointment to discuss loan options.  


USDA Fruit, Vegetable and Wild Rice Planting Rules Unchanged in 2018 Farm Bill

Fruit, vegetable and wild rice producers will continue to follow the same rules for certain Farm Service Agency (FSA) programs.

If you intend to participate in the Agriculture Risk Coverage (ARC) or Price Loss Coverage (PLC) programs, you are subject to an acre-for-acre payment reduction when fruits and nuts, vegetables or wild rice are planted on payment acres of a farm. Payment reductions do not apply to mung beans, dry peas, lentils or chickpeas. Planting fruits, vegetables or wild rice on acres not considered payment acres will not result in a payment reduction.  Farms that are eligible to participate in ARC/PLC but are not enrolled for a particular year may plant unlimited fruits, vegetables and wild rice for that year but will not receive ARC/PLC payments. Eligibility for succeeding years is not affected.

Planting and harvesting fruits, vegetables and wild rice on ARC/PLC acreage is subject to the acre-for-acre payment reduction when those crops are planted on more than 15 percent of the base acres of an ARC enrolled farm using the county coverage or PLC, or more than 35 percent of the base acres of an ARC enrolled farm using the individual coverage.

Fruits, vegetables and wild rice that are planted in a double-cropping practice will not cause a payment reduction if the farm is in a double-cropping region as designated by the USDA’s Commodity Credit Corporation.


2021 ARC-IC – Farm Benchmark and Actual Yield Certification

Producers, who have a 2021 ARC-IC program contract on one or more FSA farms, must complete the certification of ARC-IC yields for each ARC-IC farm and each covered commodity planted in 2021 by not later than July 15, 2022.  

Production evidence that can be used to support the certified yields can be from the following sources:

  • Crop Insurance loss records                           ●          Sales records (buyer specific)
  • Crop Insurance APH data base records          ●          Farm stored production records, appraisals

ARC/PLC Acreage Maintenance

Producers enrolled in the Agriculture Risk Coverage (ARC) or Price Loss Coverage (PLC) programs must protect all cropland and noncropland acres on the farm from wind and water erosion and noxious weeds. Producers who sign ARC county or individual contracts and PLC contracts agree to effectively control noxious weeds on the farm according to sound agricultural practices.  If a producer fails to take necessary actions to correct a maintenance problem on a farm that is enrolled in ARC or PLC, the County Committee may elect to terminate the contract for the program year. 


Update Your Records

FSA is cleaning up our producer record database and needs your help. Please report any changes of address, zip code, phone number, email address or an incorrect name or business name on file to our office. You should also report changes in your farm operation, like the addition of a farm by lease or purchase. You should also report any changes to your operation in which you reorganize to form a Trust, LLC or other legal entity. 

FSA and NRCS program participants are required to promptly report changes in their farming operation to the County Committee in writing and to update their Farm Operating Plan on form CCC-902.

USDA Expands Farmers.gov to Include Farm Records

Producers with farmers.gov accounts can now access farm records and maps online, the latest self-service feature added to the U.S. Department of Agriculture (USDA) website.

You can quickly and easily access your land information in real time by desktop computer, tablet or phone. Capabilities include:

  • View, print and export detailed farm records such as cropland, base acres, yields, CRP acres, land ownership details, and much more;
  • View, print and export farm/tract maps that can be provided to lenders, chemical or fertilizer providers, and FSA for reporting acreage and crop insurance agents; and
  • Export common land unit (field) boundaries as ESRI shapefiles.

The ability to access these records on demand without a visit to the service center saves you time and money.

Farmers.gov now includes the most popular functionalities from FSAFarm+, the FSA portal for producers, while providing enhanced functionality and an improved user experience. A new enhancement expands the scope of accessibility to include farmers and ranchers who are members of an entity, as well as people with a power of attorney form (FSA-211) on file with FSA.

Managing USDA Business Online

Using farmers.gov, producers, entities and those acting on their behalf can also:

  • View, upload, download, and e-sign conservation documents.
  • Request financial assistance, including submitting a program application.
  • View and submit conservation requests.
  • View technical references and submit questions.
  • Access information on current and past conservation practices, plans and contracts.
  • Report practice completion and request practice certification.
  • View farm loan and interest information (producers only).

Future plans include adding the ability to import and view other shapefiles, such as precision agriculture planting boundaries.

To access your information, you’ll will need a USDA eAuth account to login to farmers.gov. After obtaining an eAuth account, producers should visit farmers.gov and sign into the site’s authenticated portal via the Sign In/Sign Up link at the top right of the website. Google Chrome, Mozilla Firefox or Microsoft Edge are the recommended browsers to access the feature.

In addition to the self-service features available by logging into farmers.gov, the website also has ample information on USDA programs, including pandemic assistance, farm loans, disaster assistance, conservation programs and crop insurance. Recently, USDA updated the navigation and organization of the site as well as added some new webpages, including “Get Involved,” “Common Forms,” and “Translations.” Learn more about these changes.
