Subject:           APHIS Removes Portions of the Townships of Batavia and Stonelick, Clermont County, Ohio, from the Asian Longhorned Beetle (Anoplophora glabripennis) Quarantine Area

Effective immediately, the U.S. Department of Agriculture’s Animal and Plant Health Inspection Service (APHIS) is removing five square miles from the Asian longhorned beetle (ALB) regulated area in portions of the Townships of Batavia and Stonelick, Clermont County, Ohio. APHIS determined that this area can be removed from quarantine after the program completed the final surveys of host trees within the regulated area. The regulated area in the Township of Monroe and the regulated area in the Township of Tate, along with the entirety of East Fork State Park and portions of the East Fork Wildlife Area, remain in effect.

 

ALB is a destructive wood-boring pest of maple and other hardwoods. ALB was first discovered in the United States in New York in August 1996. ALB was later detected in areas of Illinois (1998), New Jersey (2002, 2004), Massachusetts (2008, 2010), and Ohio (2011). After the completion of control and regulatory activities and following confirmation surveys, the program declared ALB eradicated from Illinois (2008); Hudson County, New Jersey (2008); Islip, New York (2011); Union and Middlesex Counties, New Jersey (2013); Manhattan and Staten Island, New York (2013); and Suffolk and Norfolk Counties, Massachusetts (2014). Program activities continue in the boroughs of Queens and Brooklyn and Nassau and Suffolk Counties in New York; Worcester County, Massachusetts; and Clermont County, Ohio.

Removal of Portions of the Townships of Batavia and Stonelick, Clermont County, Ohio as a Quarantine Area for the Asian Longhorned Beetle (Anoplophora glabripennis)

This Federal Order removes five square miles from the Asian longhorned beetle regulated area in portions of the Townships of Batavia and Stonelick, Clermont County, Ohio.

 

This Federal Order is issued pursuant to the regulatory authority provided by the Plant Protection Act of June 20, 2000, as amended, Section 412(a), 7 U.S.C. 7712(a). The Act authorizes the Secretary of Agriculture to prohibit or restrict the movement in interstate commerce of any plant, plant part, or article, or means of conveyance, if the Secretary determines the prohibition or restriction is necessary to prevent the dissemination of a plant pest within the United States. This Federal Order is also issued pursuant to the regulations promulgated under the Plant Protection Act found at 7 Code of Federal Regulations (CFR) 301.51.

 

Effective immediately, the Animal and Plant Health Inspection Service (APHIS) is decreasing the ALB regulated area by five square miles in portions of the Townships of Batavia and Stonelick, Clermont County, Ohio.

 

Federal Orders amending quarantined areas of Ohio have been necessary due to the ongoing delimitation and control of the Asian longhorned beetle (ALB) infestation. This Federal Order updates and replaces all previous versions of Federal Orders pertaining to the modification of quarantine areas in the ALB domestic regulations.

The APHIS Administrator has determined that a quarantine area in the locations listed above no longer needs to be regulated to prevent the human-assisted spread of ALB after the completion of control and regulatory activities, and based on the results of negative surveys of all regulated host plants within the above quarantine area. APHIS has determined that the portions of the Townships of Batavia and Stonelick, Clermont County, Ohio have met the criteria for removal of the Federal quarantine for ALB. Therefore, effective immediately, all interstate movements of ALB regulated articles from the above described area are no longer required to be in accordance with the regulations promulgated pursuant to the Plant Protection Act found at 7 CFR 301.51 et seq. and any applicable provisions of previous Federal Orders.

 

APHIS has confirmed ALB infestations in various areas of the United States. The Administrator has determined that it is necessary to regulate these areas in order to prevent the human-assisted spread of ALB. The areas regulated to contain the spread of ALB are designated in the Federal regulations located at 7 CFR 301.51-3 and in the Federal Orders, which are located at the following APHIS website:
