Subject:           APHIS Removes Portions of Five Counties in New York from the Golden Nematode (Globodera rostochiensis)Regulated Area

Effective immediately, the Animal and Plant Health Inspection Service (APHIS) is removing 193,782 acres from the golden nematode (GN) regulated area in Cayuga, Seneca, Steuben, Suffolk, and Wayne Counties in New York. APHIS is removing the quarantine area in these five counties based on survey results and other criteria in the “Canada and United States Guidelines on Surveillance and Phytosanitary Actions for the Potato Cyst Nematodes, Globodera rostochiensis and Globodera pallida.” The attached Federal Order describes the regulated area and includes the associated reference to 7 Code of Federal Regulations (CFR) 301.85-2(a) that lists the provisions for the movement of GN-regulated articles.

 

GN attacks the roots of potatoes, resulting in reduced crop yields and negative impacts on trade. The agency’s regulations are intended to prevent the spread of GN within the United States. APHIS has regulated some of these areas since the 1950s.

 

APHIS, working closely with the New York State Department of Agriculture and Markets, has removed 1,102,131 acres from the GN regulated area in New York since 2010. Of the remaining 186,534 acres regulated in eight counties, APHIS considers 5,945 acres to be infested with GN and have an active control and mitigation program in place to prevent its spread.

Removal of Portions of Cayuga, Seneca, Steuben, Suffolk, and Wayne Counties in New York, as a Quarantine Area for the Golden Nematode (Globodera rostochiensis)

This Federal Order removes 193,782 acres from the golden nematode (GN) regulated area in Cayuga, Seneca, Steuben, Suffolk, and Wayne Counties in New York.

 

This Federal Order is issued in accordance with the regulatory authority provided by the Plant Protection Act of June 20, 2000, as amended, Section 412(a), 7 U.S.C. 7712(a). The Act authorizes the Secretary of Agriculture to prohibit or restrict the movement in interstate commerce of any plant, plant part, or article, or means of conveyance, if the Secretary determines the prohibition or restriction is necessary to prevent the dissemination of a plant pest within the United States. This Federal Order is also issued pursuant to the regulations promulgated under the Plant Protection Act found at 7 Code of Federal Regulations (CFR) 301.85 et seq.

 

Effectively immediately, the Animal and Plant Health Inspection Service (APHIS) is decreasing the GN quarantine area in areas in the following New York Townships: Mentz in Cayuga County; Tyre in Seneca County; Prattsburgh and Wheeler in Steuben County; East Hampton, Southampton, and Southold in Suffolk County; and Savannah in Wayne County. The infested and adjacent fields in these areas would remain under quarantine. APHIS also removes the following New York Townships in their entirety: Montezuma in Cayuga County; Cohocton in Steuben County, and Shelter Island in Suffolk County. The attachment identifies areas in these five counties that remain under regulation for GN, as APHIS has removed qualified areas in New York from the GN regulations. Effective immediately, APHIS is revising the GN regulated areas in New York State for these five counties. APHIS will soon publish a rule to update the regulations.

 

Accordingly, restrictions are no longer required on the interstate movement of GN-regulated articles from these areas. We will, however, continue to regulate the remaining acres regulated for the golden nematode in the five counties. The specific changes to the regulated areas are described in the accompanying Federal Order and are documented at:
