We are pleased to share that two new Frequently Asked Questions (FAQs) have been added to the eFiling website. These additions are part of our ongoing efforts to provide clear, accessible guidance to importers, brokers, and other stakeholders as we move toward full implementation of eFiling.
The new FAQs address common questions received by the eFiling Support Team and are intended to help users better understand their eFiling responsibilities.
Q. If I am a consumer shipping a noncommercial product to another consumer, do I need to eFile?
A. The eFiling Final Rule does not require eFiling of a certificate for noncommercial products sent from one consumer overseas to another consumer in the United States, such as a gift. Brokers or carriers facilitating these shipments may, but are not required to, file a Disclaimer Message Set, based on the guidance provided by CPSC, to inform CPSC that the shipment does not require a certificate.
Q. Does eFiling apply to used or resold products?
A. Generally speaking, regulated, finished consumer products to be distributed in commerce must comply with CPSC’s testing and certification import requirements, including eFiling. This includes overstock products that are being resold.
Products that are one of a kind and are not intended for retail sale, are not required to eFile certificate data, and instead may use disclaim A. Further guidance on disclaims can be found here.
CPSC notes that this is general guidance and importers should work with their trade partners to ensure individual compliance.
