The 2024 and 2025 General Terms and Conditions, the 2024 AmeriCorps State and National Terms and Conditions, and the Certifications and Assurances have been revised pursuant to Executive Order/Executive Memoranda.
The following revisions were made to the original 2024 and 2025 General Terms and Conditions, and are effective Monday, Jan. 20, 2025:
- Introductory paragraph under document title: Added reference to “applicable executive orders”
- Section II.B.: Added word “applicable” before executive orders
- Section III.M.1.: Removed references to gender, gender identity, and gender expression
- Section IV.: Replaced the Program Civil Rights and Non-Harassment Policy link with a link to the AmeriCorps Civil Rights webpage.
The following revisions were made to the original 2024 AmeriCorps State and National Specific Grant Terms and Conditions and are effective Monday, Jan. 20, 2025:
- Section V. C. 11: Added reference to unallowable activities that are connected to applicable Executive Orders [Note: A version available between 5 p.m. ET Thursday, Feb. 20, and 12:30 p.m. ET Tuesday, Feb. 25 identified particular executive orders. A temporary injunction on two of those executive orders led to the edit.]
- Section VII – removed reference to gender discrimination
The revised Terms and Conditions can be found in the Terms and Conditions section, on AmeriCorps’ Manage Your Grant page. The links in your Notice of Grant Award will also take you to the revised Terms and Conditions. As a reminder, State Service Commissions should share the updated Terms and Conditions with your subgrantees.
In addition to updating AmeriCorps branding and removing references to sunset grant program types, the Certifications and Assurances were revised to add the following:
Certification: I certify that the activities under this grant comply with all applicable Executive Orders and do not include any activities that promote DEI activities.
Assurance: Compliance of activities under this grant with all applicable Federal anti-discrimination laws is material to the government’s payment decisions for purposes of section 3729(b)(4) of title 31, United States Code (according to Ending Illegal Discrimination and Restoring Merit-Based Opportunity, Executive Order January 21, 2025);
If your organization submitted an application or amendment between approximately 5 p.m. ET on Wednesday, Feb. 12, and approximately 2 p.m. ET on Tuesday, Feb. 25, the certification and assurance language predated the temporary injunction, as follows:
Certification: Ending Illegal Discrimination and Restoring Merit-Based Opportunity, Executive Order January 21, 2025 I certify that the legal applicant does not operate any programs promoting Diversity, Equity, and Inclusion (DEI) that violate any applicable Federal anti-discrimination laws.
Assurance: Compliance in all respects with all applicable Federal anti-discrimination laws is material to the government’s payment decisions for purposes of section 3729(b)(4) of title 31, United States Code (according to Ending Illegal Discrimination and Restoring Merit-Based Opportunity, Executive Order January 21, 2025).
You may request an amendment to align the certification and assurance language with the post-injunction language.
