The Centers for Medicare & Medicaid Services (CMS) issued guidance to announce an updated interpretation of section 1903(v) of the Social Security Act (the Act), which authorizes federal financial participation (FFP) for care and services necessary for treatment of an emergency medical condition for aliens ineligible for full Medicaid benefits. Specifically, CMS is announcing a change in the agency’s interpretation of how section 1903(v) of the Act applies to Medicaid managed care payments to improve program and fiscal integrity in the Medicaid program.
