Mandatory EEI Filing Requirements for DEA Form 486

DEA Form 486, “Import/Export Declaration for List I and List II Chemicals”, is required when a DEA listed chemical meets or exceeds a specified quantity threshold as specified in Title 21 Code of Federal Regulations (CFR) 1313. When the DEA Form 486 is provided to the DEA prior to import or export, a DEA Transaction Number is provided.
Section 30.2(a)(1)(iv) of the Foreign Trade Regulations (FTR) defines the mandatory filing requirements for Electronic Export Information (EEI). Presently, there is a specific reference to the DEA under subparagraph (D) of this part which states: Requiring a Department of Justice, Drug Enforcement Administration (DEA) export permit (21 CFR 1312).
However, please be advised that it has come to U.S. Census Bureau’s attention that DEA considers DEA Form 486 to be an export permit, and therefore, filing EEI is required.
The U.S. Census Bureau will work with the DEA to revise Section 30.2(a)(1)(iv)(D) to ensure any DEA permit or declaration that requires prior registration or notification with the DEA requires filing. In the meantime, please ensure that all exports involving a DEA Form 486 have an associated EEI filing completed, regardless of value and destination.
