United States Environmental Protection Agency Annual Reporting Notification Pesticide Report for Pesticide-Producing and Device-Producing Establishments Reporting Year 2023

SUBJECT: Annual production reports for the 2023 reporting year are due March 1, 2024.

To: Producers operating pesticide-producing and device-producing and their authorized agents

Each active EPA-registered pesticide-producing and device-producing establishment, foreign or domestic, must report production for the 2023 calendar year on or before March 1, 2024. Even if you did not produce pesticides or devices during the calendar year 2023, you must submit an annual production report. You can review this list of domestic and foreign establishments to confirm that an establishment’s registration is active.

If you have already registered for electronic reporting, go to https://cdx.epa.gov and login with your existing username and password. You will be prompted to create a passphrase when you begin your annual report. Your passphrase is different than your CDX password. Do not forget your passphrase because a passphrase CANNOT be reset or recovered.

If you have not yet registered for electronic reporting, EPA encourages you to electronically submit your annual production reports for foreign and domestic establishments using the EPA’s Section Seven Tracking System (SSTS). With SSTS, you can:

  • Enter all your annual production data into your internet browser.
  • Copy over data from the previous year’s electronically submitted report (EPA Form 3540-16).
  • Quickly submit applications for registration of new establishments (EPA Form 3540-8).
  • Have reports processed with fewer delays.
  • Use the system to check the status, edit or amend those form(s) for which you retain the passphrase.
  • Save the time and costs of printing and mailing paper reports.

Click HERE for information and step-by-step instructional videos on electronic reporting.

If you are mailing reports to the EPA, please note that many EPA staff work from an alternate work location for part of the week and may not be on site to immediately confirm receipt of mailed documents.

EPA may initiate steps to terminate the registration of any establishment that does not report on or before March 1, 2024. If EPA terminates your establishment registration, you are no longer able to legally produce pesticides and devices regulated under FIFRA for sale or distribution in the U.S., which includes importation into the U.S. Additionally, failure to submit a complete and accurate report by the required due date may subject you to enforcement action, including the assessment of civil penalties and/or criminal fines for violations of FIFRA.
