Requirements of Colleagues-in-Training to Disclose Criminal Charges
We would like to remind colleagues-in-training, there is a contractual obligation to inform the St Helens and Knowsley Trust’s (StHK) Lead Employer Head of HR, their Host Primary Manager, Health Education England, and their professional body immediately after an arrest, a caution or any criminal charge.
Full information about the nature of the caution or the charge or the reasons for the arrest must be provided at the time. Furthermore, following the initial notification, there is a continued requirement for the colleague to keep StHK Lead Employer fully informed about all developments and to comply with any requirements of their professional body in relation to keeping them informed. This obligation remains in place whether or not any criminal proceedings are issued against a colleague and whether or not a matter goes to court. Any breach of these requirements will be treated extremely seriously.
The decision whether to take disciplinary action (or any other action), or not, will take into account whether the arrest, caution, charge or conviction is one that is relevant to the trainee’s employment, or makes them unsuitable for the type of work undertaken and / or for employment by StHK.
In all cases, having considered the facts, StHK Lead Employer will need to consider whether the trainee poses a risk to patients or colleagues and whether their conduct warrants investigation and/or exclusion from the workplace and/or other restrictions or adjusted duties. StHK Lead Employer will give serious consideration as to whether the trainee can continue with their role once criminal charges have been made, which will depend on the nature of the alleged offence.
Reasonable Adjustments Passport & Guidance
As part of the Lead Employer’s ongoing commitment to ensure that all doctors and dentists in training with disabilities and long-term health conditions have access to the support that they need, managers and staff can now make use of an Adjustments Passport and Guidance.
Developed in consultation with disabled staff, managers and the Building Abilities Network, the Passport and Guidance offers a template and supplementary information for staff and managers to document decisions around workplace adjustments.
Adjustment Passport and Guidance
We would like to encourage you to familiarise yourself with the policy and the passport, and approach your Host organisation for a confidential conversation about workplace adjustments.
While not all trainees with long-term conditions and disabilities will require workplace adjustments, these tools assist in ensuring that available options are explored and consistently documented, and that taking a compassionate approach to identifying and removing barriers that you may face remains at the heart of workplace adjustment conversations.
