 Two operators who failed to ask for a period of grace or find an
alternative transport manager when their shared CPC holder couldn’t carry out
his role have lost their licences.
The sole trader and limited company licences were both revoked by
North East Traffic Commissioner, Tim Blackmore, after failing to meet the
professional competence requirement.
Mr Blackmore heard that the nominated transport manager, who
served both licences, had been unable to perform his duties for several months
due to ill health.
The sole trader and limited company failed to tell the Office of
the Traffic Commissioner, nominate a suitable replacement or ask for a period
of grace.
Mr Blackmore described the failures as a “serious oversight”. He
said there can be significant ramifications for public safety where standard
licence holders run vehicles without a transport manager.
They’re legally responsible
for ensuring effective management of the transport operations, particularly in
the management and monitoring of drivers’ hours. In this case, both operators
had been reported for inadequate drivers’ hours monitoring and management.
