Please note: our decisions are published six weeks after they are issued to councils, care providers and the person who has made the complaint. The cases below reflect the caselaw and guidance available at the time of issue and the individual circumstances of each case.

    Summary: We will not investigate this complaint about the Council’s handling of planning enforcement matters at a residential development where the complainant purchased a property. It is reasonable to expect the complainant to have contacted us sooner and to pursue a claim for any property damage via the courts.

    Summary: We will not investigate Mr X’s complaint about the Council’s handling of a planning enforcement matter. This is because the complaint is late and the matter does not cause Mr X significant injustice warranting further investigation.

    Summary: We will not investigate Miss X’s complaint that the Council has approved planning permission for hundreds of new dwellings as ‘minor’ development without consulting the local water company, causing the public sewer system to become overwhelmed. This is because there is not enough evidence of fault by the Council and the injustice Miss X claims stems from issues with the sewer system, rather than the Council’s actions.

    Summary: We will not investigate Mr B’s complaint that the Council has delayed deciding his planning application. This is because it was reasonable for Mr B to put in an appeal to the Planning Inspector.

    Summary: We will not investigate this complaint about the way the Council dealt with a planning application because it can be considered by the courts.

  • London Borough of Ealing (22 013 034)

    Summary: Ms X complained about how the Council dealt with her full plans building regulations application. Ms X said the Council’s failures caused her additional costs. We ended our investigation as it was unlikely to result in a finding of fault, a recommendation of a remedy or any other meaningful outcome.

  • Bristol City Council (22 008 546)

    Statement Not upheld Enforcement 12-Apr-2023

    Summary: Mr X complained about the way the Council handled planning and enforcement matters in 2013 when converting a listed building into flats, one of which he now owns. Mr X said a neighbour’s decking encroaches into his garden and the external storage space he owns has utility meters in it. Mr X said this caused stress, and tension with his neighbour. We have discontinued our investigation into this complaint because either we cannot achieve a meaningful outcome given the passage of time since the events, or the matters are outside our jurisdiction.

    Summary: We will not investigate this complaint about the Council’s handling of a planning application for an extension at a property next to the complainant. This is because the complaint does not meet the tests in our Assessment Code on how we decide which complaints to investigate. There is not enough evidence to conclude that fault is likely to have affected the outcome.
