A weekly update on housing complaint decisions

Please note: our decisions are published six weeks after they are issued to councils, care providers and the person who has made the complaint. The cases below reflect the caselaw and guidance available at the time of issue and the individual circumstances of each case.

    Summary: We will not investigate this complaint that the Council failed to assess a woman’s homelessness case. This is because the woman has separate review and appeal rights she can use to dispute the Council’s decision that she is not homeless.

    Summary: We will not investigate this complaint about the suitability of housing accommodation which Ms X accepted under the Council’s homeless duty in 2022. It was reasonable for Ms X to challenge suitability by way of review and an appeal to the County Court.

  • Dudley Metropolitan Borough Council (22 003 592)

    Summary: Mr X complained about the Council’s decision in relation to his housing application and how it managed his complaint. The Council was not at fault for how it assessed Mr X’s housing application. There is a lack of evidence in relation to how the Council managed his complaint. Therefore, we have not investigated this matter further.

  • Chelmsford City Council (22 009 160)

    Summary: There was no fault in how the Council decided Miss X’s priority on the housing register. The Council properly considered her circumstances when she first applied to the housing register and requested a health and housing award. It also reviewed her banding when she asked it to, all while following its allocations policy.

    Summary: We will not investigate this complaint about the Council placing Mr X in unsuitable accommodation and for refusing to offer him a managed move to accommodation which is suitable for his needs. This is because there is insufficient evidence of fault.

  • Royal Borough of Kensington & Chelsea (22 010 477)

    Statement Upheld Other 10-Apr-2023

    Summary: The Council was at fault for failure to provide Ms X suitable temporary accommodation when risk of domestic abuse and significant disrepair made her current accommodation unsuitable. The Council was also at fault for its failure to communicate effectively with Ms X and with another Council. The Council has agreed to apologise, make a payment to Ms X, and act to improve its service.

    Summary: We will not investigate this complaint about the Council’s assessment of Miss X’s housing application. There is insufficient evidence of fault which would warrant an investigation.

  • London Borough of Brent (22 013 436)

    Statement Upheld Homelessness 10-Apr-2023

    Summary: Mrs B complained about how the Council handled her homelessness application when she was threatened with homelessness in June 2022. She said its communication was poor and it wrongly closed her case. She said because of this, she was sofa surfing while heavily pregnant. We found fault with the Council for delays offering Mrs B interim accommodation and progressing her homelessness application. These faults caused Mrs B significant injustice. The Council will apologise and make a financial payment Mrs B to remedy this. It will also make service improvements.

  • Royal Borough of Kingston upon Thames (22 015 851)

    Summary: We will not exercise discretion to investigate this complaint about hostel accommodation which Miss X occupied during 2019 and 2020. This complaint was received outside the normal 12-month period for investigating complaints. There is no evidence to suggest that Mr X could not have complained to us sooner.

    Summary: We will not investigate this complaint about how the Council managed Mr X’s application to join the housing register. This is because there is insufficient evidence of fault by the Council.

  • London Borough of Wandsworth (22 017 096)

    Summary: We will not investigate Mr X’s complaint about the Council’s handling of his housing application. He says his banding priority is not reflective of his housing need. This is because there is insufficient evidence of fault with how the Council considered Mr X’s housing application.

    Summary: Miss X complained the Council failed to provide her with suitable advice about a rent increase from her private landlord. We did not find fault with the Council causing an injustice to Miss X.

  • Guildford Borough Council (22 013 037)

    Statement Not upheld Homelessness 05-Apr-2023

    Summary: Mr X complained the Council wrongly rejected his application to join the housing register and discriminated against him on the grounds of his race and disability. There is no evidence of fault in the way the Council has considered Mr X’s requests to join the housing register.
