Momentous month for building safety

October was a significant month for BSR. Mandated under the landmark Building Safety Act 2022, a number of important milestones in setting up the regulator came into effect.

These milestones included:

  • BSR is now the building control body for building work involving HRBs
  • registration of HRBs is now mandatory
  • registers have opened for building control inspectors & building control approvers

Regulating the building control profession

As well as BSR becoming the Building Control Authority for higher-risk buildings, further steps towards regulating the whole of the building control profession in England were introduced last month.

Building control inspectors appointed to undertake any type of building control work in England will need to register with BSR ahead of the profession becoming regulated in April 2024.

 

To complete the registration process, inspectors will be required to demonstrate competence in their work and compliance with the Building Safety Act 2022, as well as existing building regulations. Additionally, all private sector businesses that want to undertake building control work must also apply to register as a building control approver (RBCA).

 

From 1 April 2024 it will be an offence to carry out building control work if you are not a registered building inspector or approver.

Sandra Ashcroft, competence work stream lead in the Building Safety programme at HSE, says: 

 

“Becoming a Registered Building Inspector is a commitment to public safety. Both the public and the built environment rely on the expertise and diligence of inspectors to make certain that buildings are constructed and maintained to rigorous standards of safety and quality.

 

“The BSR has set rigorous standards that all inspectors must meet. This means that every individual practicing in the building control sector will be held to the same high bar, guaranteeing a consistent level of competence across the board.

 

We are encouraging all building control professionals to act now and undergo assessment as soon as possible, ahead of when registration becomes mandatory from April 2024.”

 


HRBs registration – an update

Following the 1 October deadline for registering all high-rise residential buildings in England, BSR is working to ensure all incomplete, duplicate or erroneous applications are either completed or removed.

Those who had started applications but not submitted them are being contacted directly and offered assistance to help solve any issues they may still be having.

 

The number of registration applications submitted or waiting to be submitted is currently 12,318.

 

It is now a criminal offence to have not completed the registration process for all existing in-scope buildings in England.

 

The register will be published in the coming months.

The ‘golden thread’ of information about a building ensures that those responsible for its safety have the right information in order to understand the building, and the steps needed to keep both the building and the people living in it safe.

Retaining accurate, up-to-date and easily accessible information about a building also enables dutyholders to demonstrate they are fulfilling their legal duties.

Government news round-up

The Department for Levelling Up, Housing and Communities has published a number of guidance documents relating to the legal criteria for determining whether a building is considered a higher-risk building under the Building Safety Act 2022.

 

Read the full guidance collection.

 

New guidance has been published on reporting a mandatory occurrence. You must submit a mandatory occurrence report for all building safety occurrences that resulted in, or are likely to result in:

 

  • the death of a significant number of people
  • serious injury that needs immediate treatment in hospital for a significant number of people
  • a permanent or irreversible disabling condition to a significant number of people

 

Last month the government also issued a response following the consultation outcome to residents’ voice, golden thread information and the duties on the accountable persons to provide information.
