Proposed Submission East Riding Local Plan Update

Regulation 19 Consultation – 24th October to 5th December 2022

We are writing to you because you have previously shown an interest in, or the council believes you may have an interest in, the East Riding Local Plan Update. We would like to know your thoughts on the strategy and sites in the proposed plan.

The Local Plan sets out the vision and planning policies for the area for the next 15 years. It is a key driver in determining planning applications and development opportunities, including identifying land allocations for specific types of development such as housing and employment, in the East Riding.

The current Local Plan was adopted in 2016 and has been undergoing a process of review and update. We previously sought people’s views in 2018 and again in 2021 on a Draft Update.

We are now asking for your views on the latest version of the update, titled the Proposed Submission Local Plan Update. This is the final time we will ask your views on the Local Plan Update before it is submitted to the Secretary of State for Examination. We will also be holding a series of drop in events where you can see and discuss the Plan.

An Independent Planning Inspector will consider the responses received. The Inspector concludes through a final report whether the Plan is sound and legally compliant, can be made so with changes, or it is not. Adoption of the Plan is undertaken through a Full Council process. It is expected that the Examination in Public will take place in 2023.

The purpose of this stage of consultation

This stage of the Local Plan Update process is called the Proposed Submission. It is the version of the Local Plan that the council wishes to submit for examination by an independent Planning Inspector. At this stage we are asking your opinion on whether you believe the Local Plan Update:

  • is legally compliant,
  • is sound, and
  • complies with the duty to cooperate.

The way you can comment is set out by Government. An explanation of the above terms is set out in the guidance notes that accompany the response form. If your comments relate to the way the Council has prepared the Local Plan Update, it is likely to be a matter of legal and procedural compliance. Comments concerned with the actual content of the Local Plan Update are likely to be concerned with whether the Plan is sound. If after you have read the guidance notes, you are unsure how your comments relate to the terms, please contact a planning officer using the details in this correspondence.

Following this consultation, the Proposed Submission documents and any responses will be submitted to the Secretary of State for an Examination in Public. An Independent Planning Inspector will consider the responses received. Adoption of the Plan is undertaken through a Full Council process.

It is expected that the Examination in Public will take place in 2023. Those who are suggesting changes to the Plan may ask to be involved in the Examination in Public.

The consultation documents

From Monday 24th October to 11.59pm on Monday 5th December 2022 the following documents will be published for a 6 week period of public consultation. These are the documents that we wish to hear your views on:

  • Proposed Submission Strategy Document Update - sets out the updated planning policy for development in the East Riding. This includes the broad amount and location of development, for uses such as housing and employment, to be brought forward over the plan period to 2039. Additionally, policies relating to different issues such as protecting landscape character, minimising the risk of flooding and providing affordable housing are also addressed in this document.
  • Proposed Submission Allocations Document Update - sets out site specific policies for how residential, employment, retail and mixed use allocations should be developed in order to meet the targets of the Strategy Document. Allocations include the re-allocation and de-allocation of existing adopted Local Plan sites, along with some new sites.
  • Proposed Submission Policies Map Update - a series of supporting Policies Maps show the exact locations where development is proposed, as well as areas that should be protected from development.
  • A range of background and evidence base documents supporting the aims of the Local Plan Update will also be published and available for comment in what is known as the Document Library. The library includes weblinks to the information. These documents may help you understand the decisions that have been made when preparing the Local Plan Update.

The key evidence base documents include:

  • Sustainability Appraisal - assesses whether the policies are a sustainable option for the future.
  • Habitat Regulations Assessment – assesses the impact of policies on internationally designated sites.
  • Consultation Statement - setting out how the Council has previously consulted on the Local Plan Update and how those comments have helped shape the Update.

The Strategy Document Update, Allocations Document Update and Policies Map Update are  available to view in hard copy at all East Riding libraries, customer service centres, multi service centres and certain mobile libraries during normal opening hours. How to comment

All consultation responses should be received by 11:59pm on Monday, 5th December 2022. Late responses will not be considered by the Inspector as part of the Examination.

To comment on the consultation documents, please complete the online response form at: www.eastriding.gov.uk/localplanupdate

The form is easy to use and allows you to comment on as many or few consultation documents as you wish, save your response and continue at a later date, and upload supporting attachments.

Please note, the online response form is our preferred method of contact. It allows responses to be processed more easily helping the Local Plan Update to progress more quickly.

If you choose not to use the online response form, an editable and printable version can be downloaded from the council’s website, or a paper copy can be provided on request. You can send your completed response form to forward.planning@eastriding.gov.uk or Forward Planning (AS67), County Hall, Cross Street, Beverley, East Riding of Yorkshire, HU17 9BA. If you choose not to use the response form, you must ensure that all of the information required by the form is included within your response.

A copy of the Guidance Note to accompany the response form is available on the Council’s website. It explains the process and technical terminology, to help you complete your response.

A copy of all comments will be made available to the Planning Inspector. Comments will also be made publicly available on the council’s website in due course after the consultation period has ended. The council only redacts personal data in respect of email addresses, telephone numbers and signatures. Names will be visible. To ensure we can log all responses and keep you informed of progress on the Local Plan, your details will be retained and used in accordance with our privacy notice, available to read by clicking here.
