The new Act, which received Royal Assent on 18 December 2025, introduces significant amendments to the Mental Health Act 1983 (MHA). Its purpose is to strengthen the rights and voice of the patient, ensuring that detention is used only when necessary and for the shortest appropriate period. The reforms are designed to promote autonomy, safeguard individuals, and update mental health legislation to better reflect modern principles of care.

Specialist lawyer Tim Spencer‑Lane provides an expert overview of how the Mental Health Act 2025 reforms the law on the detention and compulsory treatment of people with mental health needs who may pose a risk to themselves or others.
For those who prefer a visual guide, you can also access a detailed video walkthrough by Alex Ruck Keene KC, “Mental Health Act 2025 – How it will Change the MHA 1983,” which provides clear explanations of how the 1983 Act has been amended by the 2025 reforms.
