Mental Capacity Act 2005: case law update

MCA

The Mental Capacity Act (MCA) is designed to protect and empower people who may lack the mental capacity to make their own decisions about their care and treatment. It applies to people aged 16 and over.

It covers decisions about day-to-day things like what to wear or what to buy for the weekly shop, or serious life-changing decisions like whether to move into a care home or have major surgery.

Read this recently pubilshed case law summary from Edge Training which provides examples of recent case law involving the Mental Capacity Act based around different decisions and issues. Please see case law summary sheet here.

Learning Disability: Annual Health Checks

Mencap

People with a learning disability often have poorer physical and mental health than other people. This does not need to be the case.  It is important that everyone over the age of 14 who is on their doctor's learning disability register has an annual health check.

An annual health check can help individuals to stay well by talking to a doctor or nurse about their health and finding any problems early.

If you are worried about seeing a doctor, or there is anything they can do to make your appointment better, let the doctor or nurse know. They can make changes to help you. These are called reasonable adjustments. Please follow this link for more information about Annual Health Checks and what to expect.
