Mental Capacity Act 2005 - CSAB week of action

Commencing on 19th June 2023 CSAB will deliver a programme of learning and activity as part of a locally co-ordinated MCA week of action.

Learning from reviews and findings from recent audits indicates there is room for improvement in how the MCA is applied in practice. In response to this during the week CSAB will issue briefings, learning resources and deliver lunch and learn sessions aimed at all practitioners across the partnership. The week of action aims to improve knowledge, understanding and application of the Mental Capacity Act 2005.

The week will take the format of a 'principle' a day from the legislation to share a wide range of resources with practitioners. There is still time to book your place on a lunch and learn sessions which will use case studies and examples to bring learning to life.

Principle 1: A presumption of capacity

Principle 2: Individuals being supported to make their own decisions

Principle 1: Presumption of Capacity (Executive Functioning)

On Monday 19th June 2023, 12.30pm - 1.15pm you can attend a virtual lunch and learn session which will cover what is meant by the term “executive functioning “and what practitioners need to take account of when assessing this group. The session will also cover how to plan for a capacity assessment and example questions to ask.

Principle 2: Supported to make Decisions (Reasonable adjustments)

On Tuesday 20th June 2023 12 noon - 12.45pm you can attend a virtual lunch and learn session where you will learn more about what reasonable adjustments should be considered when assessing capacity.

The MCA states that every effort must be taken to enable a person to make their own decision. Before decision are made on behalf of a person who lacks capacity we must be able to demonstrate that we can evidence what reasonable adjustments we have used to enable the person to make a decision. This session will describe what is meant by reasonable adjustments giving practical examples you can use in practice.

Principle 3: Unwise decisions

Principle 3 of the Mental Capacity Act (MCA) is that a person deemed to have capacity is allowed to make an unwise decision.

On Wednesday 21st June 2023 12 noon to 12.45pm you can attend a virtual lunch and learn session where a short presentation will explore how people are supported in making unwise decisions under the principle of the Mental Capacity Act and if mental capacity assessments are used to override these.
