CQC's concerns about mental health services continue to escalate
Our 2021/22 Monitoring the Mental Health Act report, published this month, finds that mental health services and staff are struggling to recover following pressures placed on them during the pandemic and the resulting fallout.
Monitoring the Mental Health Act is our annual report on the use of the Mental Health Act (MHA). It looks at how providers are caring for patients, and whether patients' rights are being protected.
This year's report found that:
- Workforce issues and staff shortages mean that people are not getting the level or quality of care they have a right to expect, and the safety of patients and staff is being put at risk
- Gaps in community mental health care are compounding the rising demand on inpatient services, with delays in admission, transfer and discharge
- Urgent action is needed to tackle the over-representation of people from some ethnic minority groups and, in particular, the over-representation of Black people on community treatment orders
- The quality of ward environments is an ongoing concern, with many inpatient environments in need of immediate update and repair
- Despite the challenges facing services, we have seen examples of good practice around advance planning and applying the principle of least restriction
In 2021/22 CQC carried out 609 MHA monitoring reviews. 466 wards had an on-site visit and 143 wards had a remote review. In addition CQC interviewed 2,667 patients (2,056 in private interviews and 611 in more informal situations), and 726 carers and handled 2,434 complaints and contacts from patients and others raising issues concerning the MHA.

We are adapting our approach and timeline to implement our strategy following a full review.
Our strategic ambition is clear and remains the same. We want to drive improvements across the health and care system, helping to tackle health inequalities. But we need to make sure that we’re able to do this as smoothly as possible, particularly as providers continue to experience persistent pressures.
We've set out what is changing, and importantly what is not, so providers can be clear about what they need to do at every step.
