Car dealer found guilty of selling an unsafe vehicle

On 25 September 2019 at Coventry Magistrates Court Mr Adewale Adebiyi, aged 45 of Claybrookes Lane, Coventry and who traded as Conquest Autos Coventry from Cromwell Street, pleaded guilty to five offences in relation to selling an unsafe motor vehicle and applying misleading descriptions to it after a car they sold was found to be unroadworthy.

Mr Adebiyi had personally sold the car and had described it as being in ‘excellent condition’ and ‘drives like a brand-new car’.

An independent vehicle examiner arranged by Coventry Trading Standards identified various faults and determined the vehicle to be dangerous and unroadworthy due to long-term deep-seated corrosion in the fractured offside front road spring, a significant long-term oil leak from the nearside front shock absorber and the engine misfiring and smoking due to excessive wear.

The examiner found that all three faults had been present for a considerable time, and each fault individually should be cause for the vehicle failing its MOT test, and as a result rendering the car unroadworthy.

The 5 charges were brought under the General Product Safety Regulations 2005, the Consumer Protection from Unfair Trading Regulations 2008 and the Companies Act 2006.

Mr Adebiyi was fined £276.00 for supplying a dangerous motor vehicle and was ordered to pay prosecution costs of £1370.00, with no separate penalty for the other offences.

Shop fined for selling food past its use-by date & selling unsafe Laser Pointers

On the 25 September 2019 at Coventry Magistrates Court Mr Rebuar Shariff, aged 40 of Deegan Close, Coventry, pleaded Guilty to 10 separate offences for displaying food for sale past its use by date and for exposing for sale, Laser Pointers that were unsafe in his shop, Easy Shop - 74B-74C Walsgrave Road, Coventry, CV2 4EB.

On 13 February 2019 when Officers inspected Mr Shariff’s shop they found a total of 40 food items on display for sale which were all meat products, up to three weeks past their ‘use by’ date which were being stored outside of a fridge.

For this offence Mr Rebuar Shariff was fined a total of £880.00.

When Mr Shariff’s shop was visited again on 19 February 2019, a box containing Laser Pointers was on display on the counter.

When examined, no name or address for either the manufacturer or the importer could be found on any of the packaging. A Laser Pointer was subsequently sent for independent testing which concluded that the laser was a Class 3R which is too strong to be made available for general retail sale. It also stated that the laser was not labelled correctly as required.

For this offence Mr Shariff was fined £586.00.

Mr Shariff was also ordered to pay costs of £853.00 together with a Victim Surcharge of £88.00.

All food and laser pointers were ordered by the Court to be destroyed.
