Neighbourhood Planning and Local Referendums

Clarification

In yesterdays newsletter (8th February) it was reported that all local referendums for two neighbourhood plan areas have been suspended until after May 2021.

The wording has led to some queries regarding the current timescales for the forthcoming referendums. We apologise for any confusion that the update may have caused.  This bulletin provides further clarification on this matter.          

Change to the Regulations

The suspension to Neighbourhood Planning referendums as mentioned in the newsletter is in line with the Governments temporary regulations which were issued as a result of the Covid-19 pandemic.  Specifically, The Local Government and Police and Crime Commissioner (Coronavirus) (Postponement of Elections and Referendums) (England and Wales) Regulations 2020 .

This Regulation states:

“These Regulations postpone the days on which certain by-elections and local referendums are to be held during the period from 16th March 2020 to 5th May 2021 (“the relevant period”).

Regulation 13 postpones neighbourhood planning referendums held in accordance with Schedule 4B to the Town and Country Planning Act 1990 (c. 8).”

Position Statement 

The Council is working with the Elections Service to undertake local referendums on the Neighbourhood Plans listed below during the 6th May 2021 local elections once current restrictions are lifted.     

  • Steeton-with-Eastburn & Silsden; and
  • Haworth, Cross Roads and Stanbury.
