Commissioner of Education Rules
The following Texas Administrative Code (TAC) rule actions were filed with the Texas Register for publication in the March 27, 2026 issue.
Proposed Repeal of 19 TAC Chapter 61, School Districts, Subchapter CC, Commissioner's Rules Concerning School Facilities, §61.1031, School Safety Requirements
Summary: The proposed repeal would relocate the requirements to proposed new 19 TAC §103.1215. The proposed new rule would include updates to implement House Bill (HB) 3 and Senate Bill 838, 88th Texas Legislature, Regular Session, 2023, and HB 33 and HB 121, 89th Texas Legislature, Regular Session, 2025, and clarify requirements for school safety.
Resumen en Español: La derogación propuesta reubicaría los requisitos existentes a la nueva sección propuesta 103.1215 del título 19 del Código Administrativo de Texas [19 TAC §103.1215]. Proposed New 19 TAC Chapter 103, Health and Safety, Subchapter CC, Commissioner's Rules Concerning Safe Schools, §103.1215, School Safety Requirements
Summary: The proposed new section would relocate existing requirements from 19 TAC §61.1031. The new section would include updates to implement House Bill (HB) 3 and Senate Bill 838, 88th Texas Legislature, Regular Session, 2023, and HB 33 and HB 121, 89th Texas Legislature, Regular Session, 2025, and clarify requirements for school safety to ensure a safe and secure environment in Texas public schools.

Summary: The proposed new rule would ensure school system compliance with safety requirements, as required by Texas Education Code, §37.1085, as added by House Bill 3, 88th Texas Legislature, Regular Session, 2023.

Proposed Amendment to 19 TAC Chapter 109, Budgeting, Accounting, and Auditing, Subchapter AA, Commissioner's Rules Concerning Financial Accountability, §109.1001, Financial Accountability Ratings
Summary: The proposed amendment would update financial accountability rating information and rating worksheets for school districts and open-enrollment charter schools.

Adopted Revisions to 19 TAC Chapter 89, Adaptations for Special Populations, Subchapter AA, Commissioner's Rules Concerning Special Education Services, Division 2, Clarification of Provisions in Federal Regulations and State Law, and Division 4, Special Education Funding
Summary: The adopted revisions implement House Bill (HB) 2 and Senate Bill (SB) 568, 89th Texas Legislature, Regular Session, 2025, by updating statutory cross references, aligning provisions related to graduation requirements for students receiving special education services and regional day school programs for the deaf, and adding a new section on the noneducational community-based support services grant program. The rules were adopted with changes since published as proposed.
Effective Date: April 5, 2026
Adopted Amendment to 19 TAC Chapter 129, Student Attendance, Subchapter AA, Commissioner's Rules, §129.1031, Reporting Off-Campus Programs
Summary: The adopted amendment clarifies student eligibility and attendance reporting for off-campus programs and expands the list of entities that may provide those programs. The rule was adopted without changes since published as proposed.
Effective Date: April 5, 2026

Emergency Revisions to 19 TAC Chapter 153, School District Personnel, Subchapter EE, Commissioner's Rules Concerning Registry of Persons Not Eligible for Employment in Public Schools
Summary: New §153.1253 on temporary inclusions implements the requirements of Texas Education Code (TEC), §22A.152, Temporary Inclusion in Registry Based on Continuing and Imminent Threat to Public Welfare, which requires the commissioner of education to adopt rules and temporarily place a person in the registry if the commissioner determines that the person's continued employment at or provision of services to an educational entity constitutes a continuing and imminent threat to public welfare; and TEC, §22A.153, Temporary Inclusion in Registry for Certain Arrests, which requires the commissioner to adopt rules and temporarily include a person who is employed by or acting as a service provider for an educational entity in the registry if the person is arrested for an offense listed in TEC, §22A.201(a). The amendment to §153.1201 adds new definitions in new subsections (b), (c), and (e) to implement the requirements of TEC, §22A.051 and §22A.052, which require a superintendent or director of an educational entity to report misconduct to the commissioner, specifically inappropriate communications and failure to maintain appropriate boundaries with a student or minor as defined in State Board for Educator Certification rule.
Effective Date: March 10, 2026
