State Board of Education Rules

The following Texas Administrative Code (TAC) rule actions were filed with the Texas Register for publication in the December 22, 2023 issue.

Proposed Amendment to 19 TAC Chapter 33, Statement of Investment Objectives, Policies, and Guidelines of the Texas Permanent School Fund, Subchapter A, State Board of Education Rules, §33.2, Distributions to the Available School Fund
Summary: The proposed amendment would reinsert information related to the Permanent School Fund distribution policy that was mistakenly repealed when 19 TAC Chapter 33 was revised to implement Senate Bill 1232, 87th Texas Legislature, Regular Session, 2021.

Public Comment Period: December 22, 2023-5:00 p.m. on January 22, 2024. The SBOE will take registered oral and written comments on the proposal at the appropriate committee meeting in January-February 2024 in accordance with the SBOE board operating policies and procedures. A form for submitting public comments on proposed SBOE rules is available on the proposed SBOE rules web page.
Proposed Effective Date: 20 days after filing as adopted with the Texas Register

Proposed Amendment to 19 TAC Chapter 109, Budgeting, Accounting, and Auditing, Subchapter C, Adoptions By Reference, §109.41, Financial Accountability System Resource Guide
Summary: The proposed amendment would adopt by reference the updated Financial Accountability System Resource Guide, Version 19, which would include allowable costs for dyslexia and related disorders added by House Bill 3928, 88th Texas Legislature, Regular Session, 2023.

Summary: The proposed amendment would correct punctuation errors in one student expectation.

The following Texas Administrative Code (TAC) rule action was filed with the Texas Register for publication in the December 22, 2023 issue.

Proposed Amendment to 19 TAC Chapter 109, Budgeting, Accounting, and Auditing, Subchapter EE, Commissioner's Rules Concerning Financial Accounting Guidelines, §109.5001, Financial Accountability System Resource Guide
Summary: The proposed amendment would adopt by reference the Financial Accountability System Resource Guide, Version 19, which would include allowable costs for dyslexia and related disorders added by House Bill 3928, 88th Texas Legislature, Regular Session, 2023.

Commissioner of Education Rule Review

The following Texas Administrative Code (TAC) rule review notice was filed with the Texas Register for publication in the December 22, 2023 issue. To view the notice in the Texas Register, go to the Secretary of State website.

Proposed Review of 19 TAC Chapter 103, Health and Safety, Subchapter AA, Commissioner's Rules Concerning Physical Fitness; Subchapter BB, Commissioner's Rules Concerning General Provisions for Health and Safety; Subchapter CC, Commissioner's Rules Concerning Safe Schools; and Subchapter DD, Commissioner's Rules Concerning Video Surveillance of Certain Special Education Settings
Summary: As required by Texas Government Code, §2001.039, TEA will accept comments as to whether the reasons for adopting 19 TAC Chapter 103, Subchapters AA-DD, continue to exist.
Public Comment Period: December 22, 2023-January 29, 2024. A form for submitting public comments on commissioner rule review is available on the commissioner rule review web page.
