ESSER I Late Liquidation Subrecipient Data Collection Tool Launch and LEA Deadline

Background

On September 29, 2022, the U.S. Department of Education (USDE) released introductory information regarding the CARES Act funding Liquidation Period Extension being offered. TEA is required to gather data from LEAs needing the extension and submit one statewide aggregate request on behalf of those LEAs. NOTE: LEAs may not request the extension directly to USDE.

All costs under ESSER I, including equitable services to private nonprofit schools, must be fully obligated for allowable grant uses by Friday, September 30, 2022. Certain obligated costs may continue to be received and paid during the liquidation period extension. The extension does not cover all types of costs, i.e., indirect costs, staff salary or travel, due to the federal rules defining when an obligation was made.

TEA may request the extension for up to 14 additional months after the standard liquidation period (until April 1, 2024). TEA has until December 31, 2022, to request the liquidation period extension for Texas LEAs.

How to Access ESSER I Late Liquidation Sub-Recipient Data Collection Tool

An LEA that wishes to request ESSER I Late Liquidation approval from USDE must complete and submit a late liquidation request form to TEA for aggregation. The data collection tool can be found in the ESSER Compliance WorkApp here. 

LEAs will see pre-populated data (i.e., LEA Name, Grant Award, etc.) and also fields that require data to be entered by the LEA. LEAs are required to submit all required information in the data collection tool for the request to be approved by TEA to be sent to USDE for final review and acceptance.

Timeline

  • 10/31/2022 - ESSER I Late Liquidation data collection tool opens for LEAs. 
  • 11/30/2022 by 11:59pm CST - Data collection tool due from LEAs to TEA. Data submission closes. 
  • 12/31/2022 - TEA submits request on behalf of LEAs to USDE. 
  • January/February 2023 - USDE responds to request from TEA. 

Next Steps

For LEAs that do not wish to request the ESSER I liquidation extension please LEAVE the status field in the form as "Not Needed (Leave this status if your LEA will not be requesting a liquidation extension for ESSER I.)" No further information is required of your LEA. PLEASE DO NOT ENTER ANY ADDITIONAL INFORMATION.

For LEAs that do wish to request the ESSER I liquidation extension, please change the status field to "In-Progress" to indicate to TEA that your LEA is in the progress of completing this form. Please complete the form fields, all of which are required except for the "Other Sub-Recipient Specific Data Notes". Once you have completed the form, please change the status at the top of this form to "Completed (Submit to TEA.)" TEA staff might be in contact to seek clarification or ask for further information as needed. No further action is required of your LEA after you submit the form. LEAs will follow these following steps to formally request ESSER I Late Liquidation.
