Clarification regarding Program Intent Code (PIC) 43
This message is to clarify the requirement for local educational agencies (LEAs) to use program intent code (PIC) 43.
For state fiscal compliance, the Texas Education Agency (TEA) will add the expenditures coded to PICs 37 (dyslexia–general education) and 43 (dyslexia–special education) to ensure that 100% of the HB3 dyslexia allotment was expended appropriately.
For federal fiscal compliance, LEAs are required to code HB3 dyslexia allotment expenditures related to providing services to special education students to PIC 43. As stated in the July 2, 2020, To the Administrator Addressed letter, “LEAs must use this PIC (43) for expenditures associated with serving a student who has an Individualized Education Plan (IEP) that specifically states that dyslexia services are required, and the LEA uses the (HB3) dyslexia state allotment to serve that student.”
LEAs should note that PIC 43 expenditures are included in the 2020–2021 IDEA-B LEA MOE calculation. However, if an LEA is noncompliant due to underreporting their PIC 43 expenditures and then requests to adjust their PIC 43 PEIMS data, that request may be denied, and/or it may impact the LEA’s risk level.
LEAs are also reminded that the IDEA-B LEA MOE calculation will use expenditures coded only to Fund Codes 199, 420, and 437; all federal funds are excluded from the calculation.
